Amusing Scenarios

What if everyone put in for New Years Eve? Or the 3rd of July? Or Christmas Day? Or Bud Billiken Parade Day? Or any number of other dates that usually end up being staffed by officers who would otherwise be pushing a beat car? Or a tact/gang car?

Sure, it's wishful thinking, but we're going to go and encourage everyone to put in a slip for New Year's Eve. Everyone. Beat officers, tactical officers, unit guys and gals, everyone.

Let's start the experiment now. Force the City's hand. Make them violate a Federal Court ruling. At the very least, we get fines and sanctions leveled against the City, it's lawyers and the executive branch. Best scenario, we get tons of time or money, a taxpayer revolt, and maybe an eye opening experience as to who actually keep society running smoothly, even without a contract.

Then we start to apply the real pressure. All you need to play along is time on the books.

The city will file appeal by end of the week, until that is addressed, it's maintain the status quo....don' tforget TACT/GANGS are contract exempt, howdoes this effect them??? Along with non-bid units?

CUTLER BAY, Fla. - A gunman opened fire on four Miami-Dade County police officers during a traffic stop Thursday, killing one and injuring the other three. Police killed the suspect hours later, authorities said.

Dozens of officers from police departments across South Florida had been searching for 12 hours for the suspect, who investigators identified as Shawn Sherwin Labeet, 25. Miami-Dade Mayor Carlos Alvarez said Labeet was found shortly before midnight Thursday in a Pembroke Pines apartment complex about 30 miles north of the initial shooting scene.

"There was an exchange of gunfire and the subject was shot and killed," Alvarez said.


He said the family of the dead officer was informed of Labeet's death.

"They asked us for one thing," Alvarez said. "They asked us to catch the subject. Well, I'm happy to report that shortly before midnight, we found the subject."

Alvarez identified the dead officer as Jose Somohano, 37, a married father of two. Another officer, Jody Wright, 31, underwent several hours of surgery to repair her severely injured leg. The other two officers were treated and released.

The officers were conducting burglary surveillance in the Cutler Bay area of southern Miami-Dade County when they stopped the man because he was driving a car erratically, police spokeswoman Linda O'Brien said. The man opened fire with a high-powered weapon without warning and fled. It was not immediately clear whether the officers returned fire.

Labeet, who may have been wearing a bulletproof vest, fled in his car, which was found abandoned 5 miles away, officials said. An AK-47 assault rifle was found inside, Alvarez said. It wasn't immediately known if it was the weapon used in the shooting.

Cook County Sheriff Tom Dart is taking all the fun out of a stay at the county jail.
Inmates can't get an orange anymore, can't buy packs of Ramen noodles and can't lean against metal fences.

And, perhaps most painful of all, they soon won't be able to watch "The Jerry Springer Show."

It's all part of an effort to curb violence that Dart says has plagued the overcrowded facility for years.

In a Wednesday speech to the City Club of Chicago, Dart outlined several simple steps he has taken in the nine months he has been in office to gain better control of the jail.

Jail stabbings are down 25 percent since 2004, and this year, the number of shanks confiscated dropped from 38 in January to 16 in August.

Dart said he cut off oranges when he learned inmates were stashing them until they fermented, then using them for booze.

Inmates created fires in cells to cook Ramen noodles, he said, caused him to cut off that supply, too.

Other changes at the jail include the style of toothbrushes, aerosol cans and lunch trays used, not letting inmates near metal fences and changing screws used in mirrors, as inmates were using each to create shanks to stab others.

He also said he plans to change all jail TV programming to more educational fare.

Dart also ridiculed the judicial system for its lags, saying some inmates wait seven years for trial.

Policeman's Taunts Caught on Tape Posted: 2007-09-13 23:24:


ST. GEORGE, Mo. (Sept. 13) - A suburban St. Louis police sergeant has been put on unpaid suspension, accused of threatening to invent charges against a driver who caught the exchange on videotape.
The driver, Brett Darrow, 20, recorded Friday's exchange with Sgt. James Kuehnlein with a dashboard video camera he installed after past run-ins with police. (Wonder what these past "run-ins were about?) He posted the video online Saturday.
"I wanted everybody to see that this kind of stuff does happen," Darrow told the St. Louis Post-Dispatch in Tuesday's edition. "I thought if I just go to the chief or whatever, it would just get swept under the rug."
In the video, Kuehnlein approaches Darrow, who was sitting in a parked car at about 2 a.m. in a commuter lot. Kuehnlein asks for identification.
When Darrow asks whether he did anything wrong, the officer orders him out of the car and begins shouting.
"You want to try me? You want to try me tonight? You think you have a bad night? I will ruin your night. Do you want to try me tonight, young boy?"
Darrow says no.
"Do you want to go to jail for some (expletive) reason I come up with?" the police officer says. Later, Darrow says, "I don't want any problems, officer."
After about 10 minutes, Darrow is allowed to go.
The recording, posted on Google Video and YouTube on the Internet, brought more than 300 protest calls to St. George Police Chief Scott Uhrig.
"I was very displeased when I saw the actions on the video," Uhrig said. "My officers are not trained and taught to act like that."
A listed number could not be found for Kuehnlein for comment.
Uhrig said Kuehnlein stopped to talk to Darrow because police have received reports of thefts from cars in the area. But Uhrig said the officer's actions and tone were inappropriate.
"Someone either violated the law or they didn't. You don't say, I'll lock you up and then come up with why afterward," Uhrig said.

The so called suicide of John Stroger's godson (Under Federal Investigation for corruption) is very similar to the so called suicide of Hillary Clinton's law firm partner, Vicent Foster.

Hmmmmmmmmmm both were under Federal Investigation for corruption and both are very suspicious in the way they committed suicide!

I wonder if Todd Stroger was running to get the godson's legal paperwork.... Just like Hillary stole all of Vince Foster's legal paperwork?

I have a feeling this is going to blow up to be the biggest news story in Chicago in a long time!

Interesting scenario, but of course you realize that you have just advocated a job action. Which is and of itself a violation of the contract and a firing offense without union protection? I forsee the city seeing the potential of just such scenarios doing away with time due entirely you will get your earned vacation bfd's p days once those are gone your done for the year especially if people keep advocating actions such as you are.Its a far better route to just sit back and let the dust settle rather than publicizing any sort of ideas that they can react to before the issue is ironed out with agreements not that just such a scenario hasn't occured to them but why give them the ammo in writing?

Do you not see that everyone putting in slips at the same time would cause this "Undue Disruption of Service" that the court stated was necessary to deny time. This is the level that the court said the city would have to prove to deny time.

These "Amusing Scenarios" would NEVER happen.

I think people are jumping the gun on this thinking that whole watches can put in a slip for the same day or that anyone can just throw in a slip for any day they want to in order to gangster the city for anything. Think again.

Some of the people on the job will attempt to abuse this ruling and we will end up to the point where "Undue Disruption of Service" is defined the same way as "manpower." In other words just another vague term open to arbitrary and capricious interpretation.

cpd is in process of a new order , no more comp time you'll be paid for all overtime in money
and possibly buying back all comp time on the books it will save them money in the future by not having to pay ot and no more 2 hours on the end need 2hrs on the end will be wothout pay

I think alot of good points have been made on both sides of the coin.

The point I think that was trying to be made was that the city or its agents in cases like this the WC can't just decide he needs all his cars up so only 1 or 2 special people can have TD.

The lawsuits reasons and the judges decision are simple. The city must have enough staff to allow a reasonable amount of officers to use earned compensatory time. It is not any of the rank and files problem if the city doesn't have enough police officers. The city claimed we don't have any cops. The judge said go hire some and start granting TD or give OT to those officers who want it.

The mess is far from over. The city will file an appeal to stall. The contract negotiations will centainly go alot longer now that a new item is on the table. As one poster said the language is a little vague in the judges decision. The city will play games as always and say we are cooperating with the spirit of the judges ruling. I don't see alot changing in the near future except for a pile of grievances.

Someday five years down the road will see the changes that this lawsuit has made. I believe some consolidation of certain units will be made and more officers will be sent back to dists or officers who are detailed out will not longer be allowed to kept on the dist their from books.

In the District I work, I have never been denied any CU request I have put in. I have 3 years on the job, and I work on the southside. So I really don't know what all the fuss is. We're busy in my District on 3rd watch, but people still take off when they need to. I can't speak for other Districts, but it's not bad where I work. I have been bounced around a little between 1st & 3rd watch, but other than that, I love this job, and I like my District too.

New lawsuit coming up. The interview portion of the mounted unit included questioning members with children what their childcare situations are, being that the unit may require short notices to report. Big no-no, can't ask childcare situations during interviews.

Hey, Filmore and the retired suckass the reason there was a ruling is that W/Cs in the name of the city have arbitrarily and habitually denied time due for so long it takes a Federal Judge to order them to treat us fairly and still the City attempts to fuck us by appealling the ruling instead of just meekly saying we are sorry for causing Officers stress in their personal lives and we will do all in our power to treat the officers fairly. The W/C yesterday was bloviating about how he tries to give as much time as possible yadda yadda yadda, funny, I have been denied three times in six months and I always put the slip in at least a week prior to the date unless OBE. Time Due is not a "little" thing retiree it's making it to weddings, birthday parties, family functions so take your mouth off of the stuttering prick's prick and STFU.

2. This pool car situation is awful. Taxicabs look better than our fleet! A guy lives 200 feet out of the county and he has to park his shit at the courthouse? C'mon! We got guys living in Olympia Fields and they drive to the Meadows! They get to take their car home and I don't? I am aware the the Coal City and Burlington contingents screwed us, but give me a break already!

3. Medical? You want medicals? Go ahead and fuck with the schedule. You really want the medicals to go away? Then do something positive for us for once. Work to boost the morale.... Do your part as the First Deputy to leave a lasting legacy of trust, honor and pride; not fear, sorrow and burnout. We need people. These people need equipment. They need to be trained well (our FTO program is a JOKE!) and they need to be recognized for a job well done when appropriate. Morale is ZERO now.

4. The radios suck. Motorola really fucked the county on this one. God help us if one of our cops gets killed because these 5000 dollar radios doesn't work.

5. The uniforms. When are we going to start to resemble a quasi-military organization rather than a bunch of rag-tag misfits? Get rid of those STUPID BDU's, ballcaps, gymshoes, nylon belts, etc. and standardize on our class A uniforms.... We look like UPS drivers or exterminators, and not the police!

6. The secret promo interviews. You MUST be joking! Some guys get to go to your private clubhouse at the SSMCTF for their little stroke job, and the rest of us mutts get our mass-interviews with some Commander? HELLO SHAKMAN????

Chief, the blame doesn't rest solely with you.... Our fucked up local needs to get off of their agenda(s) and get a contract like the Sergeants got.

Our heroes in patrol need to get out of the gas station and handle some calls...... Quit blowing off stuff! What? Are you motherfuckers overworked?

We need a buyout to get rid of all the old decrepid deadweight....FAST!

Sorry for the rant. I am just fed up with all the bullshit. I just hope that CPD realizes that the grass isn't greener on the other side.

According to our (expired) contract Section 20.2 --Compensation For Overtime, "The officer, shall have the option of electing pay or compensatory time, at the rate of time-and-one-half, for approved overtime hours worked..."

It's important to note the OFFICER has the option of selecting pay or comp time, not a supervisor nor the city. Unless bargained away, this is guaranteed in the contract, so as stated elsewhere on the blog, it is unlikely the city can simply eliminate the comp time option unilaterally.

As SCC correctly states, this is huge! Even members with little time on the job should be able to enjoy holidays with their families, or simply be able to make plans more than four days a year by using personal days.

Personally, I would work several RDOs a month for time and half insteady of the hassle and straight time of CTA special.

Frankly, I don't see manpower shortages on holidays. According to the contract, if an officer is required to work a holiday on his RDO, he is entitled to 24 hours of comp time!!! Maybe I'll be able to afford a house on the North-side after all.

fine,take your time due to prove a point. put one man cars out there with coppers with less then two year on the job. someone will get hurt or worse, killed... but we proved our point. even if the city were forced to correct the problem and hire more coppers, it would take at least a year and a half before it would have any effect on the streets. the point of this is to not be denied time due when you request it. not to stick it up the dept's ass which will be seen as retaliatory and we'll end up loosing comp time altogether.

what's going on with Durkin Park, heard that the States Attorney Office is trying to turn it all around and make the white kids at fault. the kids and their families are being harrassed and threatened with grand jury subpeonas. they've already been interviewed but are now basically being called liars and dragged before the grand jury. were the black kids and mexican kids also dragged before the grand jury?

Tact/Gangs ARE NOT EXEMPT from the FOP Contract. They voluntarily give up some of the provisions while on Tact/Gangs but are still covered by contract. However the Dept. could make you forego this provision if you want to work Tact/Gangs just like those in Tact/Gangs now who are subject to different provisions while working Tact.

This is why you should take Job Action. I recently emailed the New York City FOP to find out what their retirees pay for hospitalization insurance. I received a prompt reply and the rep from the NYC FOP stated that they DO NOT PAY ANYTHING!!!!!Thank you Mayor Daley and the Chicago FOP. Now there's a reason for a "Job Action"

Thanks to the above post the Dept is already drafting a order stating that on the days you mentioned in the post along with a host of others, NO elective time will be granted due to a SPECIAL event and the need for additional man power.

My question is two fold:

1. Aren't holidays considered "day off holiday" and comp time not utilized?

2. Can the City and FOP negotiate in the next contract, the elimination of compensatory time as an option, in instead pay us for all overtime/ holidays? And in addition orchestrate a "one time" buy out of all amassed compensatory time over a period of time? This would be expensive, but in the meantime, eliminate all problems with staffing, and future problems with bidgeting. Don't know if any of our current "exempts" are slick enough to think of this, but i guarantee you one of them will steal the idea if someone could only read it out loud to them.

whats the definition of ample time? one week, 10 days, 1 month. a lot of the time you don't know or need the day off until a couple days before that particular day.

I luv how every small minded person thins this is a win. Do you really think that daley is going to hire more officers to compensate for the lack of manpower? Of course not or he would have already done it. Does anyone realize how much money in taxes we save by being able to take our overtime in comp time instead of cash. Our overtime is taxed at a higher percentage also. Why do you think people save their comp time until they retire. This is going to force the city into either elimiating time due all together or put limits on how long we can hold onto it. Now with current contract negotiations, is our FOP going to be able to get something in there to protect us from allowing the city to elimate or put time contstaints on comp time? No we will have to wait until the next contract. I don't think anyone has thought of all the bad things that can come out of this.

talked to my retired father about this today. He seemed to think it was unreasonable(at first) for the FOP to file such a law suit.

Upon further discussion and explaination he couldnt believe that we are so short of blue shirts. I explained that 1st and 3rd watches are running short cars and in some cases running one man cars on those watchs.

Explained TRU, the number of exempts that have been made etc.

His response was "You should all get together and agree on a certain day then see if the department denies your time." Ive got a slip ready to go and Im waiting to denied so I can march down to a FSLA attorney and file my suit.

Just the fact that the usual offender has no assets to sue for, so no lawyers will take the case becuase there is no money to be made for elimniates this option.
However if you are lucky enough to
get an offender that has money nothing prevents it. It has been done in the past same applies to traffic accidents were a civilian is at fault you have to reimburse the dept it's expenses but you get thew rest.

and possibly buying back all comp time on the books it will save them money in the future by not having to pay ot and no more 2 hours on the end need 2hrs on the end will be wothout pay

You can sue the offender. I know several officers who have done this.
However, it's hard to find an offender with money.
Second, if you win, the city will go after you to recoupe their costs for medical treatment, paid time off, and the like.

Yes for one district and one watch party, it can be done. Do the same citywide for New Years Eve and it WILL be a different story. It will cause an undue disruption of service and the city will easily be able to deny your time.

Having to detail people to other districts for basic police service to cover for entire watches taking c.u. could also be called an undue disruption of service.

When I came on the job, if you had more than 40 hours on the books, come furlough, you lost it.

That when there was no paid overtime, and only hour for hour comp time.

If the city didn't keep drqaining the districts and putting all the manpower into the "elite" units and offices there would always be enough manpower so getting time off would seldom be a problem.

Hey there ranger rick....the city CANNOT AFFORD to do away with time due. They would have to pay out an ungodly amount to anyone with time on the books, not to mention they would have to actually pay cash for every overtime incident. FLSA requires that we are compensated for overtime....get rid of time, all that is left is cash...something the city keeps saying it doesn't have. Dropping a slip is not blue flu...its taking time that is DUE.

Thanks to the above post the Dept is already drafting a order stating that on the days you mentioned in the post along with a host of others, NO elective time will be granted due to a SPECIAL event and the need for additional man power.

A special event does not mean every copper in the city has to work it. Allowing time off would not create an disruption of service. The city doesn't know how to manage its resources in case you haven't figured that out. Tell me why you need every tact team & every inside person to stand around at Bud Billiken? This is true. I remember 2 W/C's in 009 that would allow us to switch days off so we could save our comp time. This doesn't happen much anymore.

Here's the answer:
Assign everybody in the CPD to the 25 districts. Yes everybody, from the supt on down. Then detail the ones that are really needed back to their specialized duties on a temporary basis. When a district runs short, empty out the tower, Homan Square, Traffic, etc. Some say it can't be done, but the contract gives the city the right to eliminate and create units as necessary. Simple, huh?
A couple of smart kids from Mt. Carmel could fill in all the details.

Contract,Contract,Contract ect... I've been on the job for some time now & am considered an old-timer. I've read lot of these comments & I keep reading over & over the word"Contract" I don't know if this is just a convienent word to use or people are just ignorant of the fact that we DO NOT have a "Contract" The F.O.P. has a "Collective Bargaining AGREEMENT" w/the City of Chicago. & as police officers we do not have a "Union", we have a Fraternal Organization that by our vote,has the right to represent chicago police officers below the rank of sgt.What this means,as the more veteran officers already know is that the "City" from the Mayor down to the new sgt. that has a hard-on for you could care less about violating the "AGREEMENT" b/c their attitude is "Screw 'em,let them grieve it" They know your gonna win but by the time it's heard & you get back what you've lost the a/h that took it from you is either a gold star or retired. Moral; Until the rank & file get a real Contract,Binding arbitration,Binding single issue arbitration full seniority rights, the no strike claus removed & full indemnification, we will continue to be treated like endentured servants by members of "THE CLUB" that founded this department.Of coarse the above "wish list",we all know,the kid that got hired yesterday will long be retired & still none of these changes will be in place...
