Good FOP!

Excellent news boys and girls. We've been seeing this pop up in a couple of comment sections, and today it officially hit the FOP website. Things are about to change:
  • In 2004, nearly two-thousand Chicago Police officers joined together in a Federal lawsuit against the City of Chicago regarding the use of compensatory time. The officers want to be able to use their compensatory time on dates of their choosing. Lawyers from the Fraternal Order of Police, Lodge # 7, handled the case and alleged that the City was consistently violating the Fair Labor Standards Act (FLSA) whenever requests to use compensatory time were denied. The City typically uses “manpower” as an excuse for refusing to grant compensatory time off. This is all going to change.

    Yesterday, the plaintiffs obtained a judgment in their favor and against the City. The City will no longer be able to use the “manpower” excuse for denying compensatory time requests. Rather, the City will be made to follow FLSA requirements and prove that granting a compensatory time off request would result in an “undue disruption” of service. In the future, a system will have to be constructed wherein officers can replace each other when compensatory time is used. Additionally, the Federal Judge ruled that the City’s policy of refusing to pay overtime to a replacement worker is flatly contrary to Department of Labor standards and cannot cause an “undue disruption.”

    The Federal Court got it right when it stated that the FLSA does not authorize the City balancing its budgetary and public safety concerns on the backs of police personnel. The Judge has directed our lawyers to meet with the City’s lawyers before the end of the month in order to discuss changes that the City must make in order to bring it into compliance with the FLSA. The Lodge’s intent in this case was to provide its members with the right to use their compensatory time when they desire to use it. Yesterday’s decision should not only allow members to do this, it should result in additional overtime opportunities as well. We will keep you posted with all future developments.
If we're reading this correctly, if you have time on the books and want to use it, YOU CANNOT BE DENIED TIME OFF. Manpower is NOT an excuse. If the Department cannot field a car, they are either going to have to leave it unmanned, allow officers to trade days off with other officers, or pay time-and-a-half to people who are RDO (by seniority) to work the uncovered car. This is huge. The City has been told in no uncertain terms that they are subject to Federal Labor Law. Imagine that. We figure there are two ways this can play out, maybe three:
  • Daley's $220 million budget hole is about to get bigger - much bigger
  • Daley finally redraws the beats and closes 3 districts - a political bomb, but if he isn't running for office again, who cares?
  • The City goes for a full scale contract violation, either running one man cars on afternoons/midnights or undercutting the seniority system and throwing PPOs into the breach as they only have to pay them hour-for-hour time, not cash.
There's probably a few other ways this might play out, but that's how we see it right now. Depending on actions over the next few weeks, everything might change.

In regards to the judge's decision,
The city argued that they ARE VERY SHORT ON MANPOWER and cannot grant time due so easily.

HOWEVER - – Other bosses in the department (Cline etc..) bullshit that we had 13,500 sworn officers. SO . . What’s the REAL truth Mr. City Attorney???

Start bullshiting a federal judge and guess who he’s going to side with?

IN THE MEANTIME, the sergeant (T.L.) that allowed the PBPA to put HIS name on this FLSA Comp-time lawsuit was just FUC%ED OVER by the city and was just recently dumped to midnights in the 015th District.

The city is relentless in screwing over coppers that will stand up for what is right. THE BASTARDS SHOULD be held in contempt of court for continuing to harass and fuc% over workers seeking justice.

The city continues to violate the contract AND the law and just dogs it out in the slow moving arbitration process.

In the process, the taxpayers get screwed for all the money (hundreds of thousands if not MILLIONS) that are wasted because of their incompetence.

wow. I truly hope this does come to fruition; however, I don't see this as unlimited time due. If that is the case, than we could theoretically have a no police day....everyone takes off the same day- at the very least, SOMETHING is looking up around here!!

One thing that I have never understood is the ide of closing districts to reduce manpower.

Let's start from the top down. Where are these commanders, inside CAPS lt's, sgt, gagn, tact sgt etc going to go? I bet that they will not be eliminated.

Also, just just you par down the number of districts from 25 to whatever you still have the same square miles of city land to cover.

You could have one district but to cover that one district you still need the same number of po's to cover it as you do 25 districts.

Ok..this is what I heard..a new,double secret,unit is being planned to help shore up district manpower needs,if and when officers ask for time off. This new unit titled, The "CWB" (cleaning women brigade)unit will be commanded by Bronislawa Gryzbowski. Upon notification of a shortage, brigades of cleaning women,currently working in every unit, will infiltrate the city streets with their buckets and mops and purge the streets of gangs by knocking them senseless with their department approved metal buckets. Street thugs will run in horror when the CWB's appear on the scene.

remember it was Cleveland, Ohio FOP that won the original lawsuit that Lodge 7 jumped on the coat tails and it was started by Nolan's team way back. the Leadership of Lodge 7 has NEVER had an original thought in their lives too busy feeding at the money pit. They tried to use the Philadelphia medical coverage plan too.

until fop can control the manpower on the street by demanding a certain level of manning the beat cars like the firemen do this will have little effect I ask anyone to research the current contract that addresses the issue of the use of compensatory time and if management even has to give a reason as to the denial. for this to truly effect management the manning issue must be set in print...

One area where there is NO manpower shortae is in the exempt ranks. If a PO is neded to fill a beat car, get a do-little-or-nothing-political-suckhole out there to fill the breach and work in a damn beat car.

Anyone remember the Booz-Allen report of the mid 90's? The City paid millions for that study and report and then failed to implement many of the recommendations.

Several important recommendations that were ignored: Eliminate layers of middle management (exempt) who are not needed for anything except to fill spots with friends, cronies and golf buddies.

One other recommendation was to eliminate the inspector ranks who inspect for loose threads and other such bullshit on the street. Boox-allen said the City already has a managament system in place and that job should belong to management, Sgts, Lts etc.

They should keep only the auditing arm of the inspectors. The rest should go work districts where they are really needed. Or retire.

The City could eliminate half of all District Commanders tomorrow and never even miss a beat in operations. One commander could handle two districts easily and the City could save millions.

Don't count on that one, where would they put their friends? Efficient? Not the Chicago Police Department.

Residency is an issue that will not be forgotten or dropepd by the FOP. We are he only city in Illinois that cannot by state law bargain for residency. We need to change Illinois law, the FOP has been trying. Daley gets it killed.

This is fucking great!!! The city requires me work when I don't want to -- late arrests, beat meetings, court. Now I can take the time from these events and use it when I want to be off -- 13B!!

I am putting my slips in today to be off from 24 December to 02 January. That is plenty of notice for them. King Richie will be shelling out some big bucks to make sure the beat cars are staffed over the 13B period.

a great ,great win!!! i am in the lawsuit and encouraged others to join. i named bosses who screwed me and every other cop in the district for time while they took off and ducked out whenever they wanted .i heard many did not join for fear of retaliation. i have no career anyway just lots of time on the job. i have been trying to tell coppers this is bigger than when we went to straight shifts.get invoved people.

I agree. So far she has gotten a CR number on one of the desk crew for not bending over backwards for her and making copies for her soon after election, then she had a guy on days bounced off his car which he has had for 10 years because he told her he could not do anything about the protesers in front of her house, which includes her office in the basement. She didn't like that answer and had Starks personally call the commander and have him bumped off. Now there is a notice in the C.O. book that states "Alderman Dixon wants police presence at ALL of her meetings, regardless if it is police related or not. This includes a SGT and a beat car. SGTS will approach the alderman and introduce themselves and discuss any security matters with the alderman." This is bullshit, yet all the bosses are jumping through hoops to please her.

That is all that has been done for years, REDISTRICT without actually putting it on paper. Take from the districts and put into DOC zones in the fastest districts.

If any one from the TRIB or SUN TIMES reads this please help.We would like the Dist's manpower #'S and see just who is actually in the dist's or WHY THEY ARE NOT!
The taxpayers of each police dist should know just how many people are in uniform capable of catching bad guys or answering the radio to help them out.
What will suprise them is how many people actually have not layed hands on a bad guy in years IF AT ALL.
If each dist was featured in a Sunday Edition story as a pull out it would make for interesting reading and hold bosses feet to the fire.

why don't they dump the majority of officers from NAGIS....the majority are do-nothings that ride the coat tails of the few people with knowledge
how many have never purchased dope or have zero informants they are responsible for???
even the long term teams are doing small bullshit conspiracy cases with very little weight. they all wait for the feds to give them the big loads and then champion themselves in the news. when was the last big seizure...and the one before that. take away their take home cars they are given because they are politically connected and help us out in the districts.

The city wants to appeal this, but it will go nowhere. The 7th Court of appeals is the court that first ruled on this case. Milwaukee police lost there. The Cleveland police I believe appealed it also tho the 7th circuit and lost and went to the U.S. Supreme Court. So this case is now case law. The city wasted our tax dollars in court stalling the enviable like everything else they do.

Special Employment in the district for you! The city will not disband TRU, the extra gang teams. DOC, area mission teams, and the other 800 jobs they invented w/o hiring anyone to do them. If the arbitrator gives us the sell back of 200 hrs and/or the stipend for living in this corrupt over priced city watch for Daley to melt down and cry like a baby.

The city will appeal in order to buy time to ELIMINATE the comp time system. When you are out of personal days V-days and BFDs you will have to be absent without pay if you want a day off. Must take money for any time earned. Current time on the books will be exhausted under the current system. This will turn out to be the worst thing that ever happened.

Good FOP? The only reason FOP sued and eventually one was because of another suit in Milwaukee that was won on the same principle. People found out about it and forced FOP to file a suit. FOP originally did not want any part of this, but they had no choice. Unit Reps and a few rebellious board members forced their hand. If it wasn't for them, this suit would never have been filed.

All comp time on the books now will be paid in cash. Everyone will them have a zero time balance and all overtime in the future will be paid in cash.

You have seen the last of comp time and the city will be able to man the beats as the please.

How do you know? Do you work in NAGIS? And if you do you must just be the best officer the city has huh? Maybe we could clone 13,000 officers to be just like you!!

NAGIS has dog asses, and phone call people like every unit or district, but there is no need to lump everyone in together.

The city should just hire the officers they are budgeted for and we wouldn't have these issues!!

There are only about 1/2 of the exempt positions than there were in the late 80's/early 90's

I would love to move out of the city and get more house for my dollar. But if they did this city would go just like Detroit. Every one of our CPD CFD city worker neighborhoods would go to shit. Districts like 005 (which is hardly holding on) would go and 022 next. Then we would ride the beat and laugh like your in the ghetto of 007 and 011. Just sayin......i to would like to leave but what would happen?? Could the city make it without us holding together the few good neighborhoods it has through residency??

What have you got to loose and you may make some money, when the city denies your requests, put in 6,7,11 months in advance.

Management has to be able to limit time off, it's a safety issue for your fellow officers besides. It will be appealed, bank on it. The city will NEVER pay OT to man cars on a permanent basis. Just look at the TARA program, summer only, then they yank it to save money.

If they appeal it and lose, we should get 8 extra hours in the books for every day it was denied. Keep track of all the days you get denied from here on out. We definitely should get to cash in the 200 hours per year of comp time for our next contract.

For the person who keeps bring up residency. You need to understand what collective bargaining is. For starts, the state statute states any town/city over a million population will require residency. So if it is a state law, it is illegal to bring the issue up in collective bargaining meetings. So you need to get the law appealed and taken off the books before you can bring the issue up for a contract negotiation.

Everyone knows an officer that works there and the truth is they work 4-5 hr days, sey dog, use their take home vehicle with free gas to do personal shopping and cart their families around under the assumption they might get called out for the load of the century...ya right...what informant in their right mind would work for the cpd over the feds...cpd pays shit.....cpd gets all the hand me downs from other agencies!!!! there is no justification to give all the nagis members a free car and free gas for personal business with our budget crisis. if anyone responds this is sour grapes, they obviously work and nagis, know this is true and don't want others to know. really..even with the teams doing long term invests.......the amount amount of weight in a major US city is an embarassment...how could you argue with this?? She personally called GED Starks woofing about a BLACK 20-year veteran copper (DW) who is a bonafide worker, for not kissing her ass when she snapped her fingers. She DEMANDED that he be removed from the beat he's worked for years and has established a great rep and high levels of cooperation and appreciation from the good citizens of his beat.

Hibbitty dibbitty Dana (seeing the negative connotations of messing with hard-working cops might have) called High-Yella Charlie W who immediately called DC Cuello in 010 and ordered her to launch DW to the hispanic side of the district. She replaced him with possibly one of the most useless empty uniforms on the job.

CAPS is supposedly all about building partnerships, establishing rapport with the community and reducing crime. Here is a hard working ex-tac veteran who chooses to step up to do police work, only to be kicked in the teeth by his OWN sworn members at the request of some PMS-ing "it's MY time to be a shot caller" asshole.

She did not consult with the Beat Facilitators, DAC committee members or anyone who lives on the beat (not the beat Dixon lives on BTW) and exerted possibly illegal influence over his failure to bow and scrape in her royal presence.

Remember, there has been NO CR#, no allegations of wrongdoing, no actual discipline, just harassment and mistreatment. Step-N-Fetchit Charlie buckled like a house of cards and demanded that Cuello just can him and, I'm sorry to say, she went along with the whole thing. Her credibility has been severly damaged by this.

Telling Williams to go fuck himself would have meant her going back to Lt. rank and pay but would have been worth millions in respect and admiration from her troops.

Remember the old cop movies where some guy was getting pinched and yelled "I'll have your badge for this!"? You KNEW it wasn't gonna happen cuz what kind of police department would you have if cops could be so easily harassed or demoted/fired? So now this Mary Mitchell wanabe picks up the phone and gets her hatchetmen to shit all over a working cop for ruffling her feathers. She's not even in office a year and already throws her "authority" around like she was King Richard J. himself.

Taking negative job action for purely political reasons is ILLEGAL, right??? Fitz, are you listening? How about the citizens of 1014? Why are they deprived of the stellsr service of this officer because of someone who doesn't even live on that beat, alderman or not?

Morale is at an all-time low from shit like this. I hope he files some kind of lawsuit or grievance or complaint. The 2 pipms who catered to this bimbo's wishes and threw Danny under the bus (oh, yeah.....they're BOTH still candidates for the SUPT spot) should be ashamed and immediately removed from their exempt positions.

WRONG! I don't work in NAGIS but have friends that do, they don't work 4 hr days, in fact it's usually 8, the car is the best perk, but the department even wants to know where it's parked, and they do check, so yes, it does sound like sour grapes..

How many are going to stay and watch their co-workers leave and stay so section 8, yuppie, or CHA "Change" can move next door?? So the ? is who many total city employees are there and how many would stay if given the option? I don't know if it was 50,000 in Detroit just like i dont know the thousand number for total city employees. But i do think its a gamble little richie doesn't want to take. lets all move to the burbs like lemont,homer township,mokena, and have great schools and pay $10,000 or more in taxes, and $200.00 a month in water bills, and don't forget 100# every 2 weeks for water softener as they have city well water, buy lots of bottled water ( at least they have not yet taxed it like the city wants 25 Cents a bottle), Pay more for fuel to drive more.
