Homicide? Or Not Really?
How is this tracked? We're serious:
A teenage girl died Friday night, a day after jumping out of a moving stolen van as police attempted to approach it. A 13-year-old boy has been charged as the driver of the van, police said. [...]
The incident happened in the 6100 block of South Marshfield Avenue at 4:50 p.m. on Thursday as police attempted to approach a stolen van, according to police News Affairs Officer Daniel O’Brien.
The driver of the van, a 13-year-old boy, accelerated after seeing police while his passenger jumped out of the van, O'Brien said.
The 13-year-old asshole faces numerous traffic charges (if he survives), but as a death occurred during the course of a crime, wouldn't homicide be an appropriate charge? And if it's charged, does that make the death a homicide, which would make the count climb? D-Unit? Answers?

Even though the girl died, the driver would not be charged with her death unless it could be proven that he told her to jump out. If she knew (and she should have)that the van was stolen and she jumped out on her own, her death will be ruled accidental.

I believe if she "jumped" from the car on her own accord, the death would be classified as an "accidental death" by the M.E.'s Office. Even though PSMV is a felony, I believe that under Illinois state law in order to be charged with FELONY MURDER, the offender(s) has to be in the commission of a "forcible felony".
For those reading this who may not be the police, Felony Murder is a charge that can be used if anybody, including one of the offenders, is killed during the commission of a forcible felony.
Stopped a guy the other night who no bullshit had been convicted of two cases of first degree murder according to leads. When asked about it the douchebag who lives in oak lawn stated he did six months....six months for two counts of first degree murdreer. what a fucking joke. and here he is out to cause more chaos. unrreal. no wonder its mayhem on the streets.
Mary Mitchell will demand that the police officers be prosecuted because it is their fault the child died!
She will call on President Obama to have them indicted for civil rights violations and he will comply.

I don't think he can be charged w/ murder even if it's a forcible felony. I would think the death would have to have been a direct result of the forcible felony for the kid to be charged ... like he ran her over or she fell out as a result of his driving.
The kid probably will walk, after all he was just having fun, He didn't know any better. You know who's fault it is going to be? Another lottery windfall.

Felony Murder.
About 10 years ago, Blue Island was chasing a POS who was driving a stolen car. The POS ran a red light at 111th and Western and killed a older couple who lived in the neighborhood. The POS was convicted of Felony Murder.
The case went to the IL Supreme Court and they reversed his conviction. They set up a list of specific forcible felonies that were "inherently dangerous" to other people, like Burglary, Armed Robbery, CSA, etc... PSMV was left off the list, so was Fleeing and Eluding, even though these felonies are just as dangerous as an armed robbery.
There are three ways to commit murder in Illinois. Knowingly, intentionally, and felony murder. The court seemed to imply that the POS in the Blue Island case could have been convicted of a knowing murder because a reasonable person should have known that fleeing police could kill someone.
Would the POS in this case be charged with murder? Probably not in Illinois, absolutely never in Cook Co. Besides he's only 13 anyway, so he can't be upgraded as an adult.
