No Publicity? No Charges

  • Chicago police detectives have been questioning and want to charge a 24-year-old prison inmate with murder in the shooting death last summer of off-duty police Officer Michael Bailey, but charges aren’t being filed yet because Cook County State’s Attorney Anita Alvarez is out of town, sources told the Chicago Sun-Times Friday.

    “This case is not getting charged today because Anita Alvarez has left on vacation,” a source familiar with the case said. “Point-blank, they told us she left town [Friday] morning and won’t be around for the press conference.”

The FOP leveled a broadside at Alvarez, word is leaking to the media from "sources familiar with the investigation" and the outrage from Chicago Police is palpable.

We'll state that we believe this story to be 100% true. We know people, we get e-mails from people, there are people we can turn to that will tell us the truth every single time. We've worked with them and we trust them. And they have all told us exactly the same thing:
  • Anita won't let her minions make a statement where they might get "face time" that would enable them to run against her at some point.
We're hearing the WBBM 780 reporting from the ASA about "continuing investigations" and all the other bullshit. Remember, this is the same office that held onto the DNA results for a killer of a teenage girl and allowed him to remain free to murder two more girls in California.

Anita is full of shit and her politically connected minions not being allowed to make a statement in the case of a police murderer speaks volumes about the level of contempt she holds for all police officers

Alvarez likes to review cases first when it involves a po getting shot or killed. She wants to make sure that all the evidence is there and strong enough to get the bad guy convicted on a slam dunk case.

Scc, I heard the exact same thing on the news! Channel 7 at 430pm stated Alvarez is in Hawaii at a conference and thus the charges won't be announced till she's back so she can personally hold the press conference. What a joke. This isn't a run of the mill homicide, HE WAS A POLICE OFFICER!! ONE OF OUR OWN!

The ballot should be reserved for all sworn law enforcement officers and county municipal employees.

This must mean that their is also no contingency planning in case of an emergency where someone becomes incapacitated in that department for one reason or another.

It's all about protecting turf at the taxpayers expense no matter how much time and effort is wasted -- no matter the cost.

I mean there is no-one else in that department that is responsible enough or competent enough to make a decision!

This is NO WAY TO SERVE THE TAXPAYERS.

YOU PEOPLE WORK FOR US!

This is not how you run things.

We the taxpayers need to get a procedure on the books whereas we can start to recall these elected officials and keep recalling them and putting someone else in charge until we get someone elected and empowered that is competent enough to do the job -- for the people -- not for their own interest.

Why is anyone surprised. The Crook Co States Attorneys Office has always had an adversarial relationship with the CPD. They go out of their way to CI a case and then blame the Dets. The ASAs do no work, take the credit but accept no blame. The Cook Co States Attorney Investigators are a joke. They drive people around and MAYBE serve a summons now and then. The best was when I made Det Darren O'Brien came to our class and told us point blank that they will not charge on Probable cause (Like the rest of the United States), they only charge if they are sure they can win the case.

Wrong! The investigators are the ones asking for charges. It is ready for charging or else they wouldn't be calling it in. Yes, there are probably things that can be done (prior to trial). No we don't want another Soto, Soto was a debacle because too much time was taken and gave the offender time to build a defense and witnesses disappear! If felony review had their way, they would keep putting off the case with "CI", where do we draw the line?!

Time to eliminate Felony Review! No other County in the State has a Felony Review. This was just a back room deal made by the Daley Machine, when he was the States Attorney. Apparently anita alvarez also lost her chicago police officers assigned to her... hmmmm, she lost her private security yesterday and now is delaying charges on a passionate case that most officers want settled NOW..


"Most of the officers from the security details will go back on the street "at a savings of more than $650,000 to the taxpayers," the department said. Security was pulled completely from Cook County State's Attorney Anita Alvarez and the next head of the Chicago Housing Authority."

Have had states attorneys tell us to go back in and try to get the offender to talk after they have invoked their 5th amendment. do not trust felony review or the states attorney.

I have been a detective longer than most of the persons commenting on this blog. I have had some experience with Ms. Alverez when she actually prosecuted cases. You may not realize it but she was a good prosecutor and cared very much about the victim as well as the officers involved.

She is actually one of the few elected Cook County States Attorney's that actually worked in the trenches and knows the court system. I have had many disagreements and out and out heated arguements with ASA's over the years about charging cases but don't throw the baby out with the bath water. Most of the ASA's care about their victims and care about us as well. I have seen countless times when an ASA went to bat for a copper or a copper's relative who was a victim.

I was always critical of Anita Alverez for running on a platform that she would go after police corruption knowing full well with her experience that there is little to no corruption out there. The actual problem is blown way out of proportion by the media. We have to realize the since deciding to run for public office she is in the snake pit of Cook County Politics and has to play the game by their rules inorder to survive. Don't blame her for the system that we all work in.

Some of the comments are way out of line. And to the other know it all who thinks that Daley initiated the Felony Review System, you know nothing about the situation. Felony review was in and working long before Daley was the Cook County States Attorney. I really hate to give Daley credit for anything but I have to admit he was the best elected ASA I have had to work with as a CPD Detective. There has never been an ASA who gave as much cooperation to the CPD as Daley. Then as mayor he turns arround and completely ruins the CPD as well as the city in general.

All I'm trying to get across is that you have to cut our fellow police officers as well as the ASA a little slack now and then. Don't go mouthing off with half truths and situations that we have no direct knowledge of.

Oh, come on already. The elected state's attorney wants to be around to announce charges? That's supposed to outrage everybody?

By the way, what is it with Area 2 always announcing to the world (including the slime lawyers who show up at the area invariably) 10 seconds after they arrest someone?

Does anyone think it might be a good idea to ask one of the detectives who is actually working this case what their opinion is at this point? No, of course not. Why let the facts get in the way of a good hatchet job on someone who has been a very good friend to the police for her entire career? Disgusting.

What happens after the 48 Hr Rule runs out? Does the arrestee get released? Wouldn't that be Official Misconduct by Alvarez? Just askin.

4 8hour rule only applies to CPD. Not to any other juridication in Cook County.

The facts:

Anita Alvarez is NOT on vacation for 2 weeks, she is at a conference for a few days NOT on the taxpayer dime.

There are still things that the detectives working the case and CPD itself have said they want to complete before they call the case in for charges.

CPD has NOT asked for charges yet.

Mike Shields, Dan Gorman and the "unnamed source" should shut up and stop embarrassing themselves. I wonder if any reporter will ever listen to them again after this. That's not a good thing for the FOP membership they're supposed to represent.

The Crook Co States Attorneys Office has always had an adversarial relationship with the CPD.

This is not true. I vividly remember the days when they worked with us, and we all had the same goal-putting as many bad guys in jail as possible. At some point that goal was obscured, and the office politics (always there in some regard) became more important than the goal. It's really a shame.

I don't know where there this comes from. You obviously have never spent any time with her. I knew and worked with Anita when she was a line ASA. Nobody in the SA office worked harder for the police and victims than she did.
