Obligation?

  • Mayor Rahm Emanuel today said the city has an obligation to pay for former Mayor Richard Daley’s legal defense if he is sued for alleged police brutality conspiracies that happened under former Chicago police Cmdr. Jon Burge.

    The city will not, however, run up unnecessary legal bills to defend Daley or Burge, Emanuel said.

    “We’re not going to be reckless and let the meter run legally,” Emanuel said.

Really? Why don't we stop this one before it even starts then.

Who was Daley working for when all of this allegedly occurred? Does Rahm even remember Daley's title at the time?
  • Cook County State's Attorney
Chicago wasn't employing him at the time, nor signing his checks. So what the hell is Rahm doing promising to pay for Daley's alleged actions?

(we realize that living in Chicago, we're also paying Cook County bills, but Rahm shouldn't be spending scarce Chicago money on bills that Cook County should be covering)

I believe the question is what he knew about the deal when he was mayor, not when he was states attorney.

He's exempt from lawsuits for his time as states attorney.

If im not nistaken he can't be sued for when he was working for the count as states attorney. They are exempt along with judges. He is being sued for allegedly covering this up when he was Mayor.

Daley is ensuring that the suits with his name on it get settled out of court quickly and quietly. If the county was fighting this case and representing daley then it might mean a trial and depositions for daley... Daley will not do any of this because he does not want to get locked into anything on paper, especially when the ball gets rolling on all of these cases. They will get swept away. I predict daley wont have to do any depositions...even though if a case gets settled its usually after depositions are done and discovery is done..watch for this to end quick... I sure wish all of my lawsuits could have ended that quick. Instead ive waited years and gone though countless depositions and motions just to have them settled 4 years later..... this city is pointless

Can anybody recommend any ranges to go practice with an M4. I've been trying to get in to Area 5 the past 3 weeks and they always tell me they've got classes or there's no time available. If you're 5 minutes late for a zeroing class they'll cancel it, so what are they doing with the other 3 hours 55 minutes? This is very frustrating so any help would be appreciated.

They may already have figured out that most of the people who live in greater Cook County will raise holy hell about having to foot the bill for Richard the Second's failings.

Emanuel figures the hue and cry will be less if he simply offers to cover Daley's expenses.

So, what are we up to now? How much of Daley's expenses are we covering? About half a million a year for five chauffeurs, another sixty or seventy thousand a year in vehicles and gas, and now hundreds of thousands a year in legal fees.

Better tighten the belt some more, taxpaying citizens of Chicago, because the Daley welfare checks will have to be covered by more cost-cutting somewhere...

Hundreds of Chicago State University students received state financial aid even though their grades were so low that they shouldn’t have been allowed to enroll at the university, according to testimony Wednesday at a state hearing.

The state audit commission hearing comes after the Tribune reported last month that the South Side public university intentionally allowed failing students to remain in school to boost its enrollment numbers.

Sen. Edward Maloney, D-Chicago, chair of the Senate Higher Education Committee, revealed that 449 students during 2008-2009, who should have been dismissed for poor academic performance based on university policy, received state financial aid given to needy students.

Of those students, 106 had a grade point average of 0.0 and still received financial aid from the taxpayer-funded Monetary Award Program, known as MAP.

“This is a serious, serious situation that I really think has to be addressed,” Maloney said. “The fact that people were getting the money who were making no progress and keeping it from people who could have used it … is a tragedy.”

I am pretty sure that payment for the defense should be Cook County - not the city.

If he was state's attorney at the time of the alleged torture of prisoners, he should be covered by the county - NOT the city.

I believe that the accusation is that while Daley was Mayor he tried covering the fact that during the time he worked for the county Burge tortured his victims. In other words he covered up the facts while he was Mayor. I don't believe they are saying that while he was States Attorney he did anything wrong. The accusation is that while he was Mayor he tried covering up for Burge. This was revealed during the ex commanders trial. Just saying.

Obligation will be when the city allows dumped ex-Deputy Superintendent Michael Shields to return to CPD effective Monday, 15 August 2011 and he is placed back in an Exempt role, having access to all the young un suspecting police women on this job. This guy is a walking debt to the city. Oh, but I keep forgetting. We must look past that. He is some kin to the President of the United States.

Don't forget Exempts, he bragged with retired lazy ass Captain Glombicki who is more stupid than Tony Carothers and Eddie Welch put together. He also made it clear that if he made Superintendent, he would dump the vast majority of everyone and replace them with the likes of AWOP King Captain Terry Williams and Commander Chris Fletcher. Enough said! By the way, how much time did that Captain get? Also, how can he still hold that rank with his back ground. Isn't that an appointed position!

Commissioner Hoff was washing his own city vehicle at the car wash, do you think McCarthy would do that? With regards to the actual alleged acts before he was mayor, he is exempt since states attorneys cannot be sued or held accountable unless they really mess up.

Daley is named in the lawsuit as both Mayor and State's Attorney and the allegations say he ignored reports of the abuse during the time period he served in both positions, which is why the city is on the hook. The county obviously should share in these expenses.

Daley has some type of protection from law suits while cook county state's attorney. He is being deposed for what he did as mayor, and for that the city does have an obligation to represent him. However, you and I know that once he sits down at the dep, they will go back to his days as a prosecutor. He cannot refuse to answer questions, his attorney might object, but he will have to answer, under oath. But, I do not believe that he will ever sit for a deposition on this matter. The city will stall and then settle the case and pay out.

And as much as I detest Mr. Taylor bringing Daley into this litigation is valid. Corruption swirled about the Daley Administration for almost twenty years, and Daley the micro-manager claims to know nothing. He got away with that lie at City Hall, but he should be held accountable for his lies at the State's Attorney Office.

Try this, take a zeroing class and show up 5 minutes early instead of 5 minutes late. In fact, try showing up early for all firearms classes. That way you won't have to go on the blog and complain how they shut you out when you show up late with your dick in your hand.

The Tribune article is misleading.

From what I heard, the lawsuit alleges that while mayor, Daley received a report of the abuse and dismissed it, effectively covering it up. Daley is trying to argue that they are referring to events that occurred while as States Attorney and that he has immunity from being deposed. It's really a matter of proving who knew what and when they knew it.

Our big reward for working in 007 is that our moron commander put a letter out saying that 1st and 3rd watch must have all beat cars, both wagons, and 4 rapids up and 10-4 every night and good luck getting a saturday off. We had plenty of manpower but our ads commander created a cta mission team, all black by the way except a chosen few, and a abandoned buildings team...so those of us not special enought can't get a day off now. And the kicker is that the useless cta team, who were all dogs now all of a sudden they are the real police, have set saturdays and sundays off......way to fuck all the workers on 007 once again carothers, you truly do suck. And the best part is the guy who just got off probation is on this great cta mission team.

He is covered by "absolute immunity" for his time as Cook County State's Attorney and therefore cannot be sued for anything that occurred during that period of time. He is not covered by that same "absolute immunity" for anything that he may have done during his tenure as Mayor.

Rahm really doesn't have a choice. With a few exceptions, given that as Mayor, he was an employee of the City of Chicago, the City is obligated to fund his defense just as the City has to fund the defense of police officers or other city employees when they are sued for conduct occurring in the course of their employment.

The Sun-quirer tries to make it sound like it was Rahm's choice and it just simply is not.

The CCSA would be the appropriate person to refer such a situation to. I can't see how he completely escape responsibility for failing to supervise his department, but it is not like he had any power to prosecute anyone for anything.

As a practical matter, what is he going to do? The result of any CPD investigation of alleged misconduct by a CPD member is never going to be trusted by anyone outside the department.

I think he did the best thing he could under the circumstances.

I have to wonder why Daley and the rest of the powers that were at the time chose not to have a serious invesitgation of this whole mess. maybe they thought it was just better to cover it up as best they could as most incidents of this type were.

Read today's Kass column. Kass also points out that Daley was first informed of the alleged abuses while he was CCSA. He might have carried over the 'curtain' to the city as Chicago's Mayor in the early 90's, but he first ignored the problem when he was the County's top prosecutor. Let Preckwinkle deal with it, the coverup started there first!

Breczek was Police Superintendent when he sent that letter to Daley.

Why didn't he deal with Burge?

I've always wondered who was Burge's clout. The man moved up in the department at Huberman like speeds. Was Breczek, who was little more than a glorified clerk, scared to take on Burge himself?


Breczek also has a huge axe to grind with Daley since he ran against him in 84 for States Attorney and later Daley unsuccessfully prosecuted Breczek for hiring his flight attendant girlfriend as a "decorator/designer" for the police department.

Now Flint Taylor's interest is finding out what Daley knew around 1992 when he had been Mayor for 3 years and the Burge stuff was just hitting the fan. Burge was forced out in 1993.

I will venture a guess that former Mayor Daley's answers will involve variations of "I don't remember" for the deposition.

As far as I'm concerned Daley, Breczek, Burge AND Flint Taylor should be used to clean up the Japanese nuclear facilities.

So many comments here assume Burge was guilty of torture. Burge was never convicted of torturing anyone. Comments on this page also don't tie into the latest news about the Innocence Project and David Protess, that he lied, broke the law and bought of testimony in cases to get evidence to free so called innocent convicts. Evidence was also presented at the Burge trial that the Peoples Law Office did the same thing against Burge. Clearly there was some abuse against Andrew Wilson in 1982, but he had just murdered two police officers during a month in which four officers were shot, three murdered all by a collection of sociopaths who knew each other and were wrecking havoc on the south side. Look at the evidence against Burge in the Wilson case. It's not very convincing.

Just to be clear--Daley was not an ASA (Assistant State's Attorney) at the time of the Burge problems, he was THE State's Attorney of Cook County.(SA) I'm always amused at how many people on here refer to Daley, Devine, and Alvarez as the "ASA" It's like referring to McCarthy as "Deputy Superintendent" or something.

Question ? I understand that the states attorney and assistant states attorney's can not be held liable for cases they bring to trail. I am okay with that. This is a different issue. These were cases in which the defendants accused the police of torture. They accused the police of forcing them to confess to crimes they did not commit. The states attorney at the time was Daley. As I understand it, he refused to investigate these alligations, or covered them up. He then went on to prosecute these defendants. Is not that an issue he, and his office can be held liable for ?

Can anybody recommend any ranges to go practice with an M4. I've been trying to get in to Area 5 the past 3 weeks and they always tell me they've got classes or there's no time available. If you're 5 minutes late for a zeroing class they'll cancel it, so what are they doing with the other 3 hours 55 minutes? This is very frustrating so any help would be appreciated.

Try going to the academy on 1st watch Monday to Friday or on Saturday's from 0900 to 1500 hours. Good luck. P.S.- Watch how some other poster will say something to this original poster like "you are idiot", "can't you fucking call the other ranges?", etc...

The state audit commission hearing comes after the Tribune reported last month that the South Side public university intentionally allowed failing students to remain in school to boost its enrollment numbers.

Sen. Edward Maloney, D-Chicago, chair of the Senate Higher Education Committee, revealed that 449 students during 2008-2009, who should have been dismissed for poor academic performance based on university policy, received state financial aid given to needy students.

Of those students, 106 had a grade point average of 0.0 and still received financial aid from the taxpayer-funded Monetary Award Program, known as MAP.

“This is a serious, serious situation that I really think has to be addressed,” Maloney said. “The fact that people were getting the money who were making no progress and keeping it from people who could have used it … is a tragedy.”

Off topic: McNutty's meeting with the Lts.

McNutty held his long awaited meeting with the Tact Lts. occurred to day at 1300 hrs. Lt. Mike Ryan from 022 didn't show. Three other Lts. didn't show either.
McNutty said that he is going to mix up the Cmdrs.
of all the districts, meaning a district in a white area
could wind up with a black Cmdr., and vice versa.
He also said he was going to expand the desk Sgt.
duties, meaning they will essentially run roll calls,
A & A sheets, etc., basically watch commander duties. 3 Street Deputy spots are going to be brought back. DTEB was there, but the Supt. asked him to leave, stating "it's just gonna be us (Supt. & Lts.) here for a while." The meeting lasted for about 90 minutes, and it wasn't a bad one. IT's just going to be really interesting to see how McNutty is going to integrate the commanders in the districts, as he is now living in one of the most segregated cities in North America. Good luck with THAT!

Of course Richard Daley will be "taken care of" by we the taxpayers, per Rahm, paying for Daley's legal defense, just as we will pay for Daley's unnecessary and morally unjustifiable police detail until he drops dead.

Men totally lacking in character, honor, honesty, integrity, and goodness are at the political helm in Chicago. We are stuck with them until they are kicked out of office by an enraged public. Until the majority of citizens wake up, and become indignant enough to throw these weasels out of office, we have no choice but to watch them make one morally bankrupt decision after another.

We also need a Department that is not connected to the very dirty and shameful politics of "The Chicago Way." John Kass is virtually a lone voice, documenting the "politics as usual" that has been going on for decades in Chicago.

I had high hopes for our new superintendent. Compared to Mayer Daley's horrific failure, the cowardly Jody Weis, the installation of McCarthy looked like it would be an improvement, and in some ways, it is. McCarthy was reportedly a good policeman when he worked for NYPD.

I watched the St. Sabina video where McCarthy gave his famous speech blaming black gun violence on "government-sponsored racism," and denigrating the NRA (that caused the SCOTUS to overturn the city's blatantly unConstitutional gun ban). My heart sank, watching him spew one demented opinion after another. He was acting in his official capacity as a employee of the Chicago Police Department. Because the things he was saying were a combination of false logic, an illogical reference to Sarah Palin, and blatant political pandering to the false and spiritually bankrupt philosophy of Phleger, he should have prefaced his commentary with a statement that he was about to say things that are his personal opinion, and do not represent the Department, just as I did at the beginning of this post.

Like it or not, he presented his comments as those of the Department. It reminded me of when Weis gave a public endorsement of candidate Obama in 2008, in violation of Department policy. Everyone is entitled to their opinion, but not to present it publicly as that of the Department.

I pray that Superintendent McCarthy can move beyond the St. Sabina fiasco, and demonstrate the will to do what is right and moral, and make good decisions in his office. I am assuming he has a contract similar to what Weis had, that can insulate him from politics, IF he chooses to go that route. That was one of Weis's failings. Weis COULD have done a lot of good, if he chose to, because he was protected by his contract. Instead, he caved-in to dirty Chicago politics, and left behind a legacy of one shameful, incompetent, and cowardly decision after another.

What will McCarthy's legacy be? Only time will tell....

My comments here are my own, as I exercise my First Amendment right which was memorialized in the U.S. Constitution. I say "memorialized," because our God-given rights to be a free people, to speak freely and also to defend ourselves against those with criminal intent (to the point of deadly force, if necessary), were already given to us the minute we were born, given to us by our Divine Creator, created in His image. These rights were not granted by, but merely documented in, the Declaration of Independence and the U.S. Constitution.

Gun World in Lombard might be open, their new range is centerfire rifle rated.

Check Bass Pro up near Waukegan, Gat Guns in Dundee.

Bristol Ranges in Bristol, Wisconsin is an outdoor range.

Last but not least, the Illinois State Rifle Assn. range out by Kankakee. If you want to shoot, this is the place for rifles.

The problem is not of their guilt, its of the alleged tactics used to bring about the confession, charges, trial then conviction. Violation of constitutional rights (6&8) and before I get bashed for my comment, its the same rights that protects all of us. Just look at how Daley thought he was higher than the constitution and the 2nd amendment. We cant pick and choose which one's we like and don't like based upon the individual it protects.

You say you want to practice and can't get in, but then say if you're late for a zeroing class they cancel it. Are you trying to zero or practice? If you're late for a class, that's on you. If you want to practice, I've never heard of anyone being turned away if they call in advance to make sure there's no other training going on that pulls them away to other areas. In fact, they are pretty accommodating to anyone trying to improve their skills. Try picking up the phone and keeping to a schedule.

Off topic but something that makes perfect sense. Wouldn't it bebefit the O''Hare Aviation Police to hire only C.P.D. Retirees? They'd be trained and experienced in a variety of specialties. No offense to non-CPD employees but this is a perfect place for all parties involved. A majority of retirees are working to supplement their income and stay active.

Sen. Edward Maloney, D-Chicago, chair of the Senate Higher Education Committee, revealed that 449 students during 2008-2009, who should have been dismissed for poor academic performance based on university policy, received state financial aid given to needy students.

Of those students, 106 had a grade point average of 0.0 and still received financial aid from the taxpayer-funded Monetary Award Program, known as MAP.

“This is a serious, serious situation that I really think has to be addressed,” Maloney said. “The fact that people were getting the money who were making no progress and keeping it from people who could have used it … is a tragedy.”

Be careful of what you wish for. I suspect this is mostly about getting Daley on the stand so he can claim memory loss about whatever excesses Burge was guilty of.

No matter what, Daley himself will skate. He will never be held accountable for anything he has done, at least in this life.

However, his inability to remember any of this stuff, will make Burge, et al, look even more guilty.

Or he can tell the truth, the whole truth, and nothing but the truth, and further sully the already low reputation of CPD by his admissions of what went on, and his knowledge of it.

This just cannot go anywhere "good", at least short term.

Obligation will be when the city allows dumped ex-Deputy Superintendent Michael Shields to return to CPD effective Monday, 15 August 2011 and he is placed back in an Exempt role, having access to all the young un suspecting police women on this job. This guy is a walking debt to the city. Oh, but I keep forgetting. We must look past that. He is some kin to the President of the United States.

Don't forget Exempts, he bragged with retired lazy ass Captain Glombicki who is more stupid than Tony Carothers and Eddie Welch put together.
