Eavesdropping Lawsuit

Raise your hands - who didn't see this coming?
  • A woman found not guilty of secretly recording Chicago Police officers who allegedly tried to discourage her from filing a complaint against an officer who groped her filed a federal lawsuit Friday against the city and the officers.

Tiawanda Moore, 21, claims Chicago Police responded to her home for a domestic dispute and one of the officers groped her breasts and buttocks while interviewing her in a bedroom, according to a suit filed in U.S. District Court.

  • The suit claims Moore called police to report the officer’s misconduct, and met with a lieutenant and an Internal Affairs Division officer, who discouraged her from filing a complaint.

Moore began secretly recording her conversation with the lieutenant and IAD officer on her Blackberry, according to the suit. Police then arrested her and charged her with violating the Illinois Eavesdropping Statute, which prevents people from secretly recording conversations.

It's probably best to assume everything is being recorded all the time and to conduct yourself accordingly. It's headed that direction anyway.

Blame it on the supervisors in IAD. I'm sure they said, ” HEY BOSS SHOULD WE LOCK HER UP?”

Lieutenants in IAD should have been rotated out years ago.

Maybe its time to reverse things and we can then secretly record. It's ok because its a conversation with a police officer, right.

Shame, take the bs report it probably wasn't going anywhere . How many bogus reports are there anyway. If you find yourself in this situation turn your phone on to protect yourself.

If the State modifies the current law to allow the recording of L.E. officials I have the following questions.

Will this allow the taping of Alderman as they consider themselves L.E. officials and therefore can carry firearms?

Sometimes bad laws have great outcomes. Eddie Burke in jail and placed there by Lisa Madigan!

Hey, why not file something in the courts? It's not like there is any justice being meted out there.

Tort Reform! What a joke. Dingbat has no business secretly recording others. And because of a liberal jury she gets to sue!

Just pay her and be done with it. When the judge hears the tape of the iad goofs trying to talk her out of making a complaint, it'll cost the city twice as much.

The Department will lose millions of dollars if those investigators are still working in IAD. By this being the City of Chicago you gotta figure they're still there.

This is an example of Judges/Juries not following the law. If the law says you can't do something then you can't do it. Just because you think the law is unjust doesn't mean you can find a person not guilty. If you think the law is unjust you can lobby your law maker to change it.

The Deaf Italian Bookkeeper

A Mafia Godfather finds out that his bookkeeper of 20 years, Guido, has cheated him out of $10 million.

Guido is deaf which is why he got the job in the first place.

The Godfather assumed that since Guido could not hear anything, he could never testify in court.

When the Godfather goes to confront Guido about his missing $10 million, he takes along his personal lawyer because he knows sign language.

The Godfather tells the lawyer, "Ask him where the money is!"

The lawyer, using sign language, asks Guido, "Where's the money?"

Guido signs back, "I don't know what you are talking about."

The lawyer tells the Godfather, "He says he doesn't know what you are talking about."

The Godfather pulls out a pistol, puts it to Guido's head and says, "Ask him again and tell him if he doesn't give the location, I'll kill him!"

The lawyer signs to Guido, "He'll kill you if you don't tell him."

Guido trembles and signs back, "OK! You win! The money is in a brown briefcase, buried behind the shed at my cousin Bruno's house."

The Godfather asks the lawyer, "What did he say?"

The lawyer replies, "He says you don't have the balls to pull the trigger."

Don't you just love lawyers?

When a shitbird pulls out his phone and starts audio AND video taping you without your consent, is this not an illegal act. I believe it is and the shitbird should be arrested. Agree or disagree? Isn't he/she violating the evesdroping law if audio recording us without consent? Why aren't more mutts arrested? Any thought? I would like to see a concerted effort of these guys going to jail. Seems like once we set a solid precedent the charging will get easier.

Courts in the states with these kinds of law (and there are not all that many) have consistently ruled against these provisions.

better to just learn to behave as if every second you are on the job you are being recorded. it is not far off anyway.

Illegal in Illinois, but not for long (on constitutional grounds). And DAs all over the state know it, so they won't bother with charges.

I record lot of things during work. Rather take a few days than give my assets to some animal. Beware of coppers trying to get their families to file fedreal law suits on other officers. 003,004,005,006... In 004 a 3rd watch sgt vowed to single certain officers out and give them "extra attention“. By the way, those officers are not on his log or watch. Who knew we needed to wait for sgts to kick a door in an emergency. Yes wait for the sgt to kick a door in when you hear kids screaming for dear life and also the fact that there were multiple calls. Its ok such things were recorded along with hostile comments made by the 004 3rd watch sgt. See how recording can save us? Its not the animals on the street people! Its the guy sitting across from you in roll call!

SCC,

This article quotes McCarthy as saying, “I actually am a person who endorses video and audio recording. There’s no arguments when you can look at a videotape and see what happened.”
http://chicagoist.com/2012/01/31/eavesdropping.php

I guess I was surprised he'd say that. What do you think?
