The Politics of Guns

A loophole, deliberately created and left open, means more headaches for those law abiding folks who wish to follow the rules:
  • Mayor Rahm Emanuel will move Wednesday to update and strengthen Chicago’s assault weapons ban to meet a deadline established in legislation legalizing concealed carry in Illinois.

    “Weapons that are designed for the battlefield have no place on the streets of Chicago,” Emanuel was quoted as saying in a press release.

    "By strengthening our ordinance, we will have a clear, comprehensive and enforceable law that continues to prevent dangerous weapons from threatening the safety of our residents. Chicago will continue to lead the way in enacting the toughest gun control measures possible while still respecting the Second Amendment rights of law-abiding citizens.

    The concealed carry bill on Gov. Pat Quinn’s desk gives Chicago and other municipalities ten days upon signage to pass new or updated assault weapons legislation.

    The legislation to be introduced at Wednesday’s City Council meeting would prohibit the import, sale, transfer and possession of assault weapons and high-capacity magazines in Chicago.
Rahm hits so many of the anti-gunner highlights that all his claims of "respecting" the Second Amendment are just so much bullshit. All this loophole does is provide Rahm with more hoops for decent people to jump through. Get a load of the "banned accessories" for guns:
  • They include: any semiautomatic rifle or handgun capable of accepting a detachable magazine and has at least one military feature; any shotgun capable of accepting a detachable magazine, has at least one military feature, or has a fixed capacity of more than five rounds; and any weapon with a fixed magazine of more than 15 rounds. Military features include “telescoping stocks, pistol grips, grenade launchers, barrel shrouds” and other features.
Well, that's just about every pistol on the Department approved carry list, not to mention the patrol rifles. Those evil "telescoping stocks," someone better tell the Alpha Girls that having a rifle that can be swapped among men with longer reaches and women with shorter arms are banned. Pistol grips that allow extra (and ergonomic) control of shot placement is a no-no. That shroud that protects your hand from getting burned by the hot metal barrel ever present during sustained use (like in training) - that's banned, too. And lord knows what the criminals might do without a grenade launcher because grenades were used in exactly how many murders last year? And speaking of murders:
  • Richard Pearson, executive director of the Il. State Rifle Association, said he’s not surprised that Emanuel is updating the Chicago ban, jumping through the window opened by the Il. General Assembly.

    But, he argued that Emanuel is “attacking the wrong people,” noting that assault weapons were used in only one crime last year on the streets of Chicago last year.

    “To attack a firearm is pretty easy—a lot easier than getting kids to stay in school so you don’t have a 49 percent drop-out rate,” Pearson said.

Stop talking sense Mr. Pearson! The peasants might realize that this is nothing more than another "show bill" put up by someone who has spent the past number of years protected by men with guns in Chicago and Washington DC.

You know what we're thinking? Rahm and Highland Park and all sorts of other 'burbs run by democrats are going to put forth every single ban they can think of, since by doing so they will be grandfathered in the new law. Then Quinn will veto the bill anyway, amending it with some inanity suggested by Bloomberg or similar morons. The legislature, by which we mean "Madigan," will bluster about the override possibility, but isn't the legislature out of session for a few months?

We sense a whole bunch of BS still to come before a watered down and unnecessarily burdensome Conceal Carry finally takes effect...and then the ISRA, NRA and Second Amendment groups will have to sue again.

Sell your drugs in the school zones because guns are banned there.. Except we all know that the bans will not have any effect except on the law abiding citizens.

One of the ordinances passed years ago by these geniuses (it might still be on the books-who can keep track!) prohibited semi-automatic versions of fully-automatic firearms. At least one department-approved firearm, the Beretta 92D is a semi-auto version of the fully-automatic 93R.

I've been in violation of this ordinance the entire time as a result!

So if the 2nd amendment of the constitution specifically addresses anything about arms and the people, why do the states or cities think they have any standing in promulgating any law about firearms if it's already noted in the constitution? It seems to me that the right to bear arms is an inalienable right per the declaration and constitution as viewed by a strict constructionist.

Not exactly. They've already scheduled a special session, "to deal with the pension crisis..." for---- July 9th. Conveniently, the day after the 7th Cir Court extension deadline for invalidating the UUW/AgUUW law.

So Quinn won't veto it outright; that would create the "court carry" cliff everyone has talked about, wherein there is no prohibition on carry. That which is not expressly prohibited is permitted. BUT, he can amend the shit out the bill; take away pre-emption, and any of the other redeeming parts of the bill, and your scenario plays out perfectly. Gun owners continue to get screwed, and the tyrants can prove they are in compliance with the court order. "We have a carry law." It sucks worse than New York's or New Jersey's, but it kicks the can down the road for a few more years while ISRA, NRA, SAF, et al sue again. And again. And again......

If I get arrested for having one of these guns, I'm going to invoke my rights under the 2nd amendment. Just like government officials have been invoking their rights under the 5th amendment. I'm also going to ask for sanctuary and amnesty. These are 2 protections that are given to illegal aliens. I would assume that I'm also given those protections.

SOLDIERS take the battlefield with arms "designed for the battlefield" with select-fire (FULL AUTO) platforms.

So any semiautomatic handgun with a pistol grip is banned? Yeah, I guess that's all of them.

So my reward for jumping through all their hoops, spending all that time and money to get a CFP and register my guns with CPD is that they turn around and ban my 7-rd pump shotgun and all semiauto pistols, and now they know whose door to kick in for a cheap and easy gun arrest of a citizen who made every effort to comply with their laws. Land of the free....

I have my FOID card and all my past FOID cards glued to a piece of wood and they make up my impermeable State if Illinois light sabre. I carry that and wear the Armor of Christ and I fear no evil. Oh, that and a level III vest and a Glock model 21.

Just a little news flash , I ride my bike a lot in the city and on a street that starts with H , perhaps as I ride by knocking on certain car windows were the occupants appear to be napping or other wise unfocused I think those guys ( i.e. your security) should have nothing but collapsible batons. Ya know no heavy weapons no M-4's no extended mags for pistols or rifles. Hey fat as some of those boys are they couldn't run 50 feet to save your sorry ass. But the point is you should be protected by the same weapons we the people are allowed by the Rahmsicles to have. lets see how that works out right ?

This past Saturday I was on my way to Oshkosh WI from Indiana. Upon reaching the IN suburbs of Chicago I stopped at a rest area. Unloaded and broke down my Glock 17 and locked it all in a case and put it in the trunk.

I happened to pass a gun store before returning to the interstate and I stopped in to inquire whether or not I needed to do anything further before entering IL or the city.

The guy in the store told me in no uncertain terms to unlock, assemble and reload the weapon and keep it next to me while in the city. His reasoning was it is better to pay a $1200 unauthorized use ticket than to wind up dead. I had to agree with him and that is just what I did.

As luck would have it an accident forced me onto the surface streets in the south and west sides. The Glock was a real comfort during those 45 long minutes.

Does that mean an M&P 9mm handgun would be included? It has a detachable magazine. But I'm not clear what a military feature is.

Very simple concept that all police should understand. Any normal law abiding citizen with a valid foid card, don't arrest them for possessing any guns, whether in their cars or on their persons. Stop violating people's rights. Call it cop nullification, just like jury nullification. Who cares what stupid anti gun laws these asshole politicians pass. Don't enforce them.

Because the 2A of the Constitution says that CONGRESS shall make no law infringing the right to pack heat. It says nothing about the states. However, some Constitutional requirements have been forced upon the states in recent years. Further, reasonable regulation is always permissible. You cannot shout "Fire!" In a crowded theater even though we have a First Amendment. Of course, the struggle is over what "reasonable regulation" means. The USSC decided that the right to "keep AND BEAR arms" at least meant carry outside the home. Hence the TOTAL Chicago ban was unconstitutional.
