Criminal Charges in California?

If we were a firefighter, we'd be steaming mad about now and looking to organize some sort of show of support for one of our own:
  • California prosecutors will determine if a firefighter will face charges in the death of a teen passenger who was aboard an Asiana Airlines jet that crashed at San Francisco International Airport. The girl was killed when a firetruck responding to the crash ran over her.

Investigators completed their probe into the incident last week and turned over their findings to prosecutors who will determine within the next two weeks if the firefighter broke any laws or whether it was an accident, said San Mateo County Assistant Dist. Atty. Al Serrato.
A plane crash is chaotic enough. A plane crash with survivors has to be hundreds of times more insane. A plane crash with survivors and bodies lying all over the tarmac, taxiways and grass...you get the picture. And they want to even consider criminal charges against the driver? We'd say "only in that liberal cesspool of California," but we can see it happening here, too.

its like when a dept or states attorney gives the results of a police involved shooting to a grand jury. Its protocol. Obviously the FF will not be charged with anything. Its a formality as many depts and counties have. Nothing really new here. The story is definitely written to get a rise out of people but its the uninformed media, what did you expect...

This is PC run amok or some lawyer looking for an easy payout or (most likely) both scenarios

Walk a mile in my shoes...
It's like the civilians who get put into 'shoot, don't shoot' scenarios. They nearly always shoot the innocents, once the adrenalin starts flowing and the stressors enter into the scenario.

But, I don't know how you put a bunch of civilians into the cab of a fire truck, driving at top speed into a plane crash site, steering that rig with foam covering the tarmac and adjacent surfaces, people screaming, survivors waving you in, radio blaring in your ear... but I'd be guessing they'd do way more damage than a trained first responder.
It's tragic that someone died, but there was no intent, no crime, no malicious or reckless act here. It's why they call them 'accidents'.

Sounds like first responders in Laughifornia should begin stoping at lights and stop signs enroute to emergencies.

At the airports use he perimeter roads or wait for a DA to guide emergency crews in.

By the way, where's the intent?

People in California live by their own unique and warped set of progressive cultural rules and morals. Some would even call it an insane fantasy world which is not governed by sense, common or otherwise. Large numbers of California peoples migrate to other states and spread their weird way of thinking.

There needs to be a fundamental change in America. Our citizens attack worse then would be killers towards first responders. With allowing lawsuits-punitive damages, possible criminal charges, demise of pensions - let alone going home at night. It's based on no decent jobs & fewer stable incomes. The nation is failing. Our leaders are terrible. As first responders, its easy to make us a target for the great animosity towards elected officials. When is enough enough ? An entire volume set can be written about the how, what Americans deserve, & what they should get, but first responders (military as well) actions & freedom of speech are limited.

What a bunch of fucking assholes! It's not like the driver was negligent in anyway. If they do go ahead and charge this firefighter then they will eventually do it to police officers. You might as well do your job according to strict policy. To cover your ass. The mere fact that they are even considering it is cause for concern.

Only in the land of left wing lunacy would this guy have to worry about such bullshit. I'm sure no one feels worse than the firefighter, but charging him would only compound the tragedy. He was doing his job, in good faith, and an accident occurred. It's ironic that the libtards want to hold someone accountable for this accident, but when the savages intentionally act like animals they choose to look the other way.

This is clearly someone looking to make a name for theirselves! Was it tragic? Yes. Was it preventable? Who knows. Was it intentional and criminal? Hell no.

Unfortunately, what happens in California is a preview of what happens in the rest of the country in a few years. I could very easily see something similar to this occurring here in Chicago.

10/05/2013 02:27:00 AM I couldn't agree with you more. Our leadership both Democratic and Republican is terrible. What we need are people to return us to our core values, not the typical hack politicians that are forced on us by both parties. Who that might be, I don't know but if we don't wake up, our society is going to go the way of the Greeks and Romans. To those who might think that is far fetched, read some history.

I really believe the family of the deaceased would rather let the matter be put to rest, but I'm certain they were contacted by some Dewey Cheatham & Howe late night personal injury law firm as well to represent the family in their moment of incredible tragedy and untimely loss of a beloved daughter.
Or is the D.A. up for reelection and needs a scapegoat.
Really surprised they haven't blamed LAPD yet for not controlling disaster traffic and posting bilingual signs and flags.

I understand what you are saying and I think that for the most part, you are correct.

However, this is California. You are talking logic, sanity and reasonableness. In California those can be rare conditions and may not apply.

As for police shootings review, true. The USDOJ reviews all police shootings. The vast majority are mere pro-forma reviews as most police shootings are right (Contrary to what the shootee's family thinks.)

I have seen numerous fire trucks blow thru red lights at high speed blowing their horn making no effort to allow the traffic to clear. If a fire truck were to strike a car and kill its occupants driving like that on streets, a case could be made for criminal charges.

Perhaps fire truck drivers should take a look at the way they operate those trucks. This may be camel nose under the tent situation. next time the driver may be sacrificed.

But not this case. A plane crash, she was thrown from the plane and covered with foam. The firefighters knew that seconds counted.

What can say about the girl's death other than "It just wasn't her day?"

This is the same state that allowed a law suit by the family of one of the North Hollywood Bank robbery offenders.

The total was eleven police officers shot and seven civilians. The two robbers died after firing more than a hundred rounds from AKs.

Those aren't regular fire trucks that ran over the victim. It was a Crash Rig, the driver sits in the middle and the cab is about 15' up. Firefighter has to climb a ladder to get in. There is no way to see the ground clearly

Two out of three wrong, so we're deleting your comment. Go back and research who the senators are from California and then google where the republican presidential candidates have been from in the last 20 years. Oh, and Schwarzenegger was a blip, barely deserving of an (r) after his name.

Again unpublished dumbass:

15 republicans? As opposed to 38 democrats? That's what? 2-and-a-half times the representation?

Romney wasn't from California as you claimed. A vacation home in LaJolla isn't residence. You can't even remember what you typed?

Our point was Arnold as a small (r) republican - a RINO. His policies were left of center except in who proposed them.

Democrat entitlement spending has driven California into debt of something like $130-plus Billion.

Nice of you to gloss over the obvious misstep about what parties the US Senators belong to.

But they aren't liberals in a hotbed of liberalism? Stop drinking the kool-aid.
