Felony Theft? Not Anymore!

The "new direction" the States Attorneys office is moving. This is an actual e-mail from the Cook County State's Attorney:
  • Hello Everyone,

    The Cook County State's Attorney's Office has a new policy concerning retail thefts.

    Felony Review will not be approving felony charges unless the property in question is valued over $1000.

    However, if felony charges are based upon the offender's prior criminal history, then charges will not be approved unless the offender has ten or more prior felony convictions. [emphasis added - SCC]

    Felony review assistants will be looking at the defendants on a case by case basis with this in mind. There will still be scenarios where felony charges are appropriate even though the $1000. value or the 10 felony conviction threshold is not met. Those cases can still be evaluated for the upgrade.

    Officers and Detectives should communicate with Felony Review or Donna Norton and myself, on specific cases that require exceptions to this general rule.

A-fucking-mazing...a States Attorney who won't prosecute a pretty straightforward State Law lest they fill Tommy Dart's jail with actual criminals. What's the felony threshold? $300? And now you can steal Three Times

Ten felony convictions. With ten felonies, you'd have been put away three-times-over in a "Three Strikes" state. Here, you just get to go steal again and again and again. As long as you don't target high end merchandise, you can furnish a couple of apartments.

Any bets on how soon this comes to Chicago? Not that they aren't already doing it under the radar, but when will they put out a notice? Loss Prevention just became a joke and everyone pays more for democrats catering to the criminal element. The gypsies just declared a national holiday.

Start filing complaints against these ASA including Kimmy with the ARDC...... Start holding them accountable, I know they have prosecutorial discretion but on some of these retail thefts NO WHERE in the statute does is specify 10 priors.....so again the likes of Kimmy and Prick Winckle and Dip Shit Dart screws over the businessman and the consumer

What the blog needs to know is in the hood managers and security guards demand arrest for minor shoplifting. They give POs no discretion and will contact supervisors because they are fed up. Any chain store ie Aldi, Savers, $general, etc..... are on their last leg in the hood.
Then, per the current law prior conviction means upgrade. There are too many $10 thefts bombarding the ASA for upgrades. Honestly it's homeless or borderline homeless offenders. DSS makes you attempt to upgrade because of law. It's a shit show.
Hey drugs aren't the problem though right???

I would still call and request felony charges on every single theft charge. Let them use up all their time and valuable resources battling us. The actual law is on our side. Now that clears the courts from having to do ANY "extra work" AND is a much more effective preventative than a slap on the wrist.

WAY out-of-line? Too violent. Too much "use of deadly force"? Punishment doesn't fit the crime?

Don't worry, stores will start moving out.

AND, not to Rosemont or Schaumburg or anywhere else that Cook County's retail tax structure or shoplifting laws have any jurisdiction.

I suspect the theft rate in the collar counties will drop like a rock. Why risk a felony charge and penitentiary time when one can steal to their hearts content in their own backyard. Work related travel expenses will be next to nothing for these sticky fingered thieves. If I'm not mistaken the felony threshold is 150.00 for subsequent retail theft arrests. 300.00 is only for the initial offense. Baltimore, we will make you proud.

It sounds like retailers will need to return to the "Service Merchandise" model from back in the 60's. You find what you want in an in-store catalog, pay for it and then stand in line until they bring it out from the warehouse in back. You can still steal something but the victim will be the fellow customer, not the retailer.

It'll all be documented.
When all the stores in "the community" close and then those on the boundaries of "the community" close, then the stores in the suburban malls close. Someone will eventually take notice. You know, when those taxes from those stores start drying up.

well, this is basicaly saying that theft is now legal in chicago. Sure, It's technically Crook County, but lets be real, businesses outside the 1st municipal district aren't going to stand for this.

We already know how the stores loss prevention reps usually don't show up for the PC hearings, so the charges are usually dropped.
We know stores often cut the offenders loose after a certain amount of time waiting for the police to respond (which is much more often lately, due to manpower).
We know that, unless the crime is captured on video, the states attorneys are going to drop misdemeanor charges (at best they will offer 3 months supervision with a plea). Felony charges aren't an option without video.
We know that misdemeanor retail thefts rarely result in jail time, even after waisting court time with a trial and conviction.
As a former professional thief (used to work for a company that developed and tested retail security options and efficiency), I can tell you that a "good" retail establishment, at best, captures 15% of thefts (and almost never catches theft from employees).

With all of that in mind, how long will it take for a person to gather up 10 CONVICTIONS, to get to the felony threshold, where there is a greater likelyhood of doing any jail time? A life time, and that's for a person who steals every time they go to a store.

So theft is now punishable by maybe 2 hours processing time, and maybe 3 hours sitting in a cell, waiting on an I-Bond. A 5 hour penalty for a $1000 score? why not? At this point, anyone who actually pays for something is going to be deemed an idiot.

Just don't rip off the dope man. That guy has a family to feed.

It has been in place for awhile.

All victim should be instructed to obtain a summons at the local court house.
keep in mind a used item that is stolen ie laptop,Ipad,Iphone,Jordan Gym shoes flat screen TV and bikes will be considered used and will not be recorded at purchase value as a loss.

NO video no case.

It will only matter when it becomes a family member and you see how wrong this is.
Recommend carry conceal to all.

Three things, Kim Foxx is already the states attorney (as of December 1st), this applies to ALL of cook county not just 5th Dist and retail theft threshold under state law is 300 or if the offender is under 300 dollars and has 1 felony conviction it meets the criteria.

The only convictions I ever saw for retail theft in the suburbs (6th Dist) were when the defendant was held on a warrant. Only then would the ASA offer the offender a plea for time served. What a joke! I wonder if judges will issue warrants when the offenders fail to appear?

So. Now Kim Foxx like so many great political philosophers Cook County judges think there job is to "Make new laws" to ease the "Struggle".
I remember when we did not have felony review. Felony review started with the election of Bernard Carey to States Attorney in I think around 76 or 77. Felony review was Carey's idea and he sold it to Old man Daley on the platform that it will unclog the courts no make everything more efficient in the government by giving everyone less work. Remember the "Machine" provided all of the patronage employees.
Before Felony Review all you did was call the dicks out they would prepare the complaints, 101s and reducers(misdemeanor) complaints. In the old Br 44 felony court the ASA would have a preliminary hearing if there was probable cause it went to a felony court room. No probable cause the arrest was reduced to a misdemeanor and sent to a lower court.
Life was good!

One of the many outrageous parts about this is that Kim Foxx made Mike Deno put his name on the memo instead of having the memo come from her. Everyone knows that Mike Deno is a very good prosecutor. This was NOT his idea. This was a direct order from new State's Attorney Kim Foxx (and therefore Preckwinkle) and new First Assistant Eric Sussman. Put your own name on it Kimmie and let the world see what kind of new pro-criminal wild west is coming to this now doomed city and county.

I look at this one this way. I get a call from retailer about a theft, take the asshole into the district and call felony review. Don't do a rejection over the phone, make the ASA come out to your location. Drag the investigation into the rush hour so it takes them a couple of hours to get to you. I'm off the street , making an arrest, and causing ASA to work their asses off for a bullshit retail theft.

They have been ridiculous in the 5th for quite a while now for Retails. Even if you have over $300, if the store has no video, they'll never approve it. Regardless of the value. Had one the other night where the Offender had 20+ convictions in theft. Because the store had him with $100 in merch, FA wouldn't approve it. It's great how Cook County just makes up the rules as they go...

They have been making up their own rules regarding non compliant registered sex offenders. If you did the same crime in a different county, you would be back in prison. Cook county Asa will not prosecute anything that has to do with non compliant registered sex offenders, no matter how blatant the offense is...one prosecutor said they simply don't like these cases on their docket. This retsil theft policy is an office wide policy coming straight from Kim Foxx to be effective immediately. The fun has just begun. Another new policy for the new State's Attorneys office is absolutely no jail time for traffic cases. This includes a recent traffic case where someone was killed. The line ASA asked for the maximum penalty which was a year in jail. After the defendant was sentenced to that year in jail, the line ASA was called into a meeting with the new first assistant Eric Sussman. Sussman told her we are no longer asking for jail time on any traffic cases. The public should be made aware of these new policies being created by Kim Foxx

Glad most criminals are dumb, as they could easily put a crew together of 10 people, everyone shops each day for less than $1,000 of merchandise per trip. $10,000 - $20,000 a day. Not sure how you sell all that shit but I am sure they can easily get some % on the dollar. Save some for fines, bail $, and just don't get caught 10 times. hohohohohoho. merry christmas. how hard is this plan.

I look at this one this way. I get a call from retailer about a theft, take the asshole into the district and call felony review. Don't do a rejection over the phone, make the ASA come out to your location. Drag the investigation into the rush hour so it takes them a couple of hours to get to you. I'm off the street , making an arrest, and causing ASA to work their asses off for a bullshit retail theft.

If I was Nieman's, Macy's or any other BIG TIME retailer, I would be closing up shop. Mag Mile? Empty Stores.

You'd see how fast they would change that law.

As for coming downtown to shop? Not anymore.

My hard-earned money will be spent elsewhere this Christmas and for many more Christmases to come.

As for the shoplifters taking merchandise out, I would simply meet them on their way out if I was a retailer and ask, "Do You believe in Jesus?"

Business owner here, I like to read this blog occasionally to get a idea of what may be going on behind the scenes, stuff the media won't report. I will tell you, as a business where in this city/county/state, I've been left no choice but to take my small business (11 total employees) and move North. I've been taxed and regulated to the point I cannot fiscally survive. When and if Chicago ever wakes up and gets rid of these thieves and crooks destroying this city, maybe we can make a return. Thanks for some great memories.

I too would like to see some investigations around here. The problem that I see, is that since we live in a BLUE state, I doubt that they really give a shit about what goes on here. The only hope is that Trump gets pissed at the poor excuse of a mayor for defying laws about immigration, etc... I noticed that Trump had a meeting with rahm's brother who is/was Trump's agent. The mayor has been consulted about the transition process and was at a meeting with former White House chiefs of staff. He probably thinks he can do no wrong with his new clout!
