Useless Felony Review

Once again, proving how Foxxx's office is overstaffed, useless, and dedicated to downgrading crime by any means possible:
  • Hey SCC, don't know if your aware but the CCSA office now wants victims of crimes that require felony review locked into a videotaped statement BEFORE felony charges are approved. Case in point:

    ...in 016 a man in car points a gun at another man driving his car over a road rage incident cause by the man with the gun. Call goes out, a beat car stops the suspect vehicle and a gun is recovered and offender arrested. The victim is in the station after he calls 911 and the bad guy brought in, positive ID of offender, vehicle and gun. Now the Kim Foxx zone, the ASA wants the beat car to go to the area and retrieve an iPod/tablet recording device and go to the victim and record the victims [statement] after 6 hrs since the arrest.

    Now the [victim] is pissed and goes home after the ASA asks the officers to ask numerous nonsensical questions to the victim about the incident. Charges are then DENIED for felony UUW. The 3rd Watch WC calls for an over ride and then the ASA comes into the station and requests the arresting officer along with a Sgt. with a camera equipped car go over to the victims residence to get the victim to stand in front of the vehicle and make his statement into the camera. Well the victim is pissed off, refuses a statement but reluctantly charges are approved by ASA almost 10 hrs after the arrest. Now go get em guys!
How about making this easier on the victims of crime? After all, we're getting paid there to be given the runaround by bottom-of-the-class, second-rate lawyers. The victim is being victimized twice - by the shithead and by the system.

Detective here. Been in the similar situations. Most of us will tell the ASA to pound salt. Approve or not. Pending video statement by victim is not a legit reason not to approve. Victim has an absolute right to refuse any recording including handwritten and demand justice.

About a week and half ago, 2 officers get into a fight with a known police fighter when they respond to a Domestic in 022. The fight occurs and the offender initially gets away until arrested the following day. The officers did not suffer any injuries. One officer was punched in the face during the encounter, glasses knocked from his face and his vest was torn. Paperwork done, TRRs done, Detectives called, witness (Baby Momma) affirms officers description of what happened. Offender (known Police fighter) admits to Detective that he fought with police and has been charged in the past. ASA Peterson contacted and REFUSES charges because she said so. Thanks Kim Foxx. Officer asked for an override and was informed by Detective that any override is being automatically dismissed in bond court. UNBELIEVABLE! Screw Kim Foxx!

over lack of I.D. We're all in the red on budgets, and the city-wide directive
is no I.D., no treatment. The illegals have bankrupted this city and used it
as a sanctuary.
Rahm: "Fuuuuucccck! I'll have your job for this, asshole!"
(at that point, Rahm keels over, directly on his back, impaling the Bowie
knife up to the handle. He is dead.)

Felony review was created in the late 1970s by SA Bernard Carey. It's works great for whomever the State's Attorney is but not so great for everyone else especially the victim. It assures the SA a high conviction rate (in the high 90s) which looks great when running for reelection. The SA office wants only cases that are a slam dunk in the trial court. An ASA trial supervisor once told me that if someone in felony review sends a case (other than the slam dunk) to a first chair that felony review person will be despised by everyone and they will have a short career with the SAO. Over the years the office has become twisted and now it's just a numbers game for the vote.

I've seen plenty of road rage incidents where even I may have been involved in and the key factor to ending it is for someone to back off. Of course no one backs off and the machismo in the car continues. Sounds like a BS incident.

So now victims are being treated like police officers. Get them to make a statement on camera so later, when asked the same questions for the 20th time, if there is the slightest deviation from the original statement, not only will charges be dismissed but that could expose the victim to legal problems when shit head sues the city and includes victim in the lawsuit for unlawful arrest and defamation of his fine, upstanding character.

hmmm... long time detective? It is not a he said/ she said case, actually ... ahem ... it is a UUW case is that not what the officer said? The officers recovered a gun, isn't that what I read? Now, it is quite possible the gun was not on the guy when recovered, and that would make the victim's statement come into play, but I kind of doubt that.

the ASA always wanted a handwritten when the victim was a POS, which is probably the case here

They are not hiring the cream of the crop and the good lawyers that do work there rarely stay long because they are surrounded by incompetence and bureaucracy. The longer they make you wait the more likely the problem and interest fades away.

As if "locking a witness statement" in video or written has any bearing even if/when a case comes before Judges like Carol M. Howard.
It makes the PO that jagbag when citizen witnesses feel they're are being treated like third class citizens when We have to do the work of the ASA.

The message is clear.
The accused community member is merely inconvenienced until witnesses gives up and go away.
It used to be points were awarded (bragging rights) for Convictions.
Now it's Denials.

The arrest is a meaningless activity.

Let's use common sense "Detective" There's a road rage incident. Happens all the time. One of the two call 911 and describe the person that (allegedly) pulled a gun on them. They describe the car which eventually gets stopped by the police and low and behold...THERES A GUN in the car. Now let's use your Detective powers of reasoning. How, I ask would the victim have known that particular offender driving that particular vehicle would have a gun in it unless the offender removed said weapon from its conceiled location and pointed it at the victim?? Riddle me that one "Detective"

So the "victim" is actually more witness than victim. I have no love for felony review, but the request is reasonable. Make the case and stop being lazy. Too much time spent crybabying. In the end, it's a gun case that's probably going no where. Victim already seems uncooperative so fuck him. It wasn't two days of round the clock work. Too many half-assers on this job that want their way then pout and whine when they don't get it. That's why we got the DOJ and the communerty breathing down our backs. Be thorough and meticulous with your investigations. Articulate on paper and in court. Be patient. Dial down the meathead copper and turn up the professionalism.

I'm not a detective here, just a man with common sense. If someone has a gun in his car and is driving down the street, how would another driver know he had that gun unless that person displayed it in some way. This person didn't call the police on random cars on the street. He called on one driver and one car, and amazingly that driver has a gun. And really the caller would be the witness. 2+2=4 in this case.

I'm all for constructive criticism of CCSA policies. It does, however, hep to have all the facts straight before slamming cars you know nothing about. What was conveniently left out of the recitation of facts in this case is that there was a second person in the vehicle the gun was recovered in. That second person happened to be the child of a 16th District officer. The person was also let go from the station before giving any statement.The gun was recovered from the back seat of the offending vehicle . Is it inconvenient to get a recorded statement from the victim? Sure, is it out of line in this situation? No .

Most ASA's really do try but are hamstrung by you know who. They are not being allowed to do the job they signed up for with this admin. So next time you personally decide to pick on any ASA that comes to a call or you deal with over the phone or even in court. Remember they are just doing as they are told just like every officer has a supervisor to answer to. As a officer myself. I have nothing but respect for the ASA's that come out and deal with us (CPD). A lot of Us (CPD)can barely print a report properly (don't even say that you don't know a officer or 2 that can't articulate what they ate for lunch let alone a nice arrest.) So without knowing the entire story I can tell you with certainty that the main reasons victims are locked in on video is because they have a background, they're a shithead, or the case is domestic related and the ASA's office does not want them to flip at trial, which happens often if they're not on video. There are some good attorneys in that office and they're being forced to follow Kim's rules just the same as we fucking follow Eddie and Rahm and all the bullshit they throw out. So let's not bash everyone in that office cause we sure as fuck wouldn't want the entire police department clumped together for something one copper does. And on a side note they have to deal with every dumbass that calls in cases too. Just like there are plenty of soft attorneys, there are also plenty of stupid ass coppers that don't have a clue and couldn't put a case on someone if their life depended on it.

Bad victims equals lock in. Also, not all witnesses or victims have to be recorded, just a good practice to do so with potential shady victims. Also, in this day and age you should want everyone's interview on video. Video confession or victim interview saved u in the future.

Long time detective here. Without all the facts and basing this on what's posted...the ASA's request sounds reasonable. Absent an independent witness or some other type of evidence, it's a he said he said case.

I'm not a detective here, just a man with common sense. If someone has a gun in his car and is driving down the street, how would another driver know he had that gun unless that person displayed it in some way. This person didn't call the police on random cars on the street. He called on one driver and one car, and amazingly that driver has a gun. And really the caller would be the witness. 2+2=4 in this case.

Felony review was created in the late 1970s by SA Bernard Carey. It's works great for whomever the State's Attorney is but not so great for everyone else especially the victim. It assures the SA a high conviction rate (in the high 90s) which looks great when running for reelection. The SA office wants only cases that are a slam dunk in the trial court. An ASA trial supervisor once told me that if someone in felony review sends a case (other than the slam dunk) to a first chair that felony review person will be despised by everyone and they will have a short career with the SAO. yes this is partly true. I was on the job in 1969 and involved in a shooting. The watch commander had to call the SA office for consultation at the time, but no ASA actually responded. It was consultation only at the time. Yes, it became a numbers game no matter who the elected SA was. Now it appears by all of these comments that it is also a racial number game.

The hood always states that the suspect might have a gun. They say it because they think the police response will be quicker.

Fingerprints or DNA on the recovered gun? Statement from offender admitting possession? Multiple people in the offending car? Location where officers recovered the gun? All of that makes a difference to judges and juries in today's climate.

A detective here, its not the usual he say she say type of case. The point, the victim calls the police and gives a description of the vehicle make, year, color and possible lic. plate. The victim also gave a description of the offender and possible type of firearm he was pointing. The police on the about information located the offender and vehicle. They find the gun the victim told them about and have all the elements to have this asshole charged with a felony UUW. So stfu detective, what corroborating facts do you not understand. To the not a detective here, good reasoning and common sense which is lacking in the D lately.

Doesn't matter.. lock them in. I would rather have a he said she said lock in than he said she said on the day of the crime then the victim come in and say, I never said any of that at trial time. Welcome to federal court then. If the victim gets locked in on video then there is no denying it and you cover your behind and have a greater potential if getting a conviction in court. Too many guys who have no experience except 011th district dope surveillance arrests and foot chase UUW saw him throw it without ever loosing sight of him blah blah blah...

I tell my victims, what is occurring every step of the process. Felony Review is a joke, they are the ASA's with least amount of experience and most of the time never make the call. They notify their supervisor of the facts and the supervisor makes the call. All of this is time consuming and I tell the victim all about the process. Most of the time the victim cooperates, and there are times where the victim just leaves. It's called, the victim refused to prosecute. General Orders have nothing to do with a victim walking. If the state wants to put the victim in front of a Grand Jury and orders he/she to testify, well so be it. So you can talk you're fucking head off to the complainant, because that person made the decision not to pursue the matter and that's the end. I thing if you are going to push a victim into signing a complaint, you maybe looking at intimidation, harassment and a CR number. The knife cuts bought way's, General Order Boy.

First off be prepared to have the victim tell you who's great idea was this.. How about this victim gives a lengthy statement;
1) doesn't have to appear at preliminary hearing
2) video is played for a grandjury for true bill
3) victim doesnot have have to make appearance for first 3 trial dates, where offender will BFW or is in Cermak with stab wounds, defense will offer motions of bullshit, defense willnot appear because he hasn't been paid
4) veracity of the victims statement is accepted by the judge and only after any objections or motions to ejaculate are disposed of the judge may require the appearance of the victim ONE time at a time of the day when the working man is not inconvenienced.

All highly unlikely because we know the offender is the most important person in any case and is afforded the most grace of the system.
