Warm Up the Bus!

If you read the entire COPA report, which we have, a few things stand out. In our opinion, one of the biggest is how many more bosses are going to have to go under the bus for this to go forward.

With the JVD shooting, a whole boatload of careers were cut short as those signing off on the investigation we encouraged (or told) to resign and anyone who couldn't ended up indicted or stripped.

Page though this investigation and you can see the fingerprints of all sorts of people who are going to have to be fired or told to resign or indicted. The Detective(s) for starters. A shit load of white shirts. And Rahm's buddy, Chief Melissa Staples. There's no way she gets out unscathed, and that is going to piss off a lot of Rahm's alternative-lifestyle big-money supporters.

Of course, with Granny Clampett leaving and running a mid-sized police department (into the ground), the novelty of naming Staples as Supernintendo may have worn off a bit. Rahm has always been one to balance the political scales against the winds of public opinion. Watch for the resignation notices to start flying if this is headed a bad direction.

Fired Cartridge Case Ejection Patterns from Semi-Automatic Firearms

William J. Lewinski, William B. Hudson, David Karwoski, & Christa J. Redmann (2010)

Investigative Sciences Journal

During testimony, “experts” often cite that spent cartridge case ejection locations from a semi-automatic firearm indicate the location of the shooter based on the assumption that most spent cartridge cases land to the right and rear of the shooter. The authors of this study investigated whether spent cartridge case ejection locations are an accurate indicator of a shooter’s location. Eight different semi-automatic weapons most frequently used by police officers were used to collect data from eleven different shooting positions. The results highlighted the significant inconsistency of the spent cartridge case ejection locations that occurred across test positions even when several factors including firearm type, firearm position, and ammunition were accounted for. Of 7,670 bullets fired, over 25 percent of the spent cartridge casings landed somewhere other than to the right and rear of the shooter where it is commonly accepted they should land. That pattern inconsistency is significant and demonstrates that determining shooter location from the spent cartridge case alone leads to only a tentative estimate of the shooter’s location.

Wow, I can't believe that this report was in the Tribune so now the public can play Monday morning quarter backs and vilify the police also. You know everybody knows the police officer's job better than the police officer without ever being one. Always think down the line to federal court in anything you do. An insignificant misc. x card you wrote five years ago could jackpot you. This lethal lizard of a mayor, and others, are annihilating this police department for their own greed. Your only recourse at this point is do nothing and don't get involved. And don't go to any awards ceremonies and shake this weasel's hand because he loves photo ops to show that everybody supports him. Why aren't the scandals in his administration in the paper every day. People file Freedom of Information Requests into this adminstration and they are ignored just like the people he worked for, the Clintons and Obamas.

Staples will not be in trouble. Guaranteed. The difference between this and JVD is many bigwigs signed off even after having viewed the video. Others, such as Sgt F, we're expected to examine all available evidence. Here there was no BWC, no in car camera, and only the two officers. What else could she have went off of but the word of the officers?

I was browsing through the report, they gave an estimate of 10-15 mins for the officers to arrive on scene! Who knows what they were doing, but that's yet another problem with "stay fetal and go slow to jobs." They could have crawled there and everything still would have happened

I don’t think Detectives are allowed to disprove witness statements based on a hunch or political motives like COPA. Charges can’t be proposed on ‘there is nothing to prove he did (or didn’t) do it the way he says, so fudgeit,,,, he is guilty.
Detectives don’t determine or look for administrative errors, that job belongs to immediate supervisors, IAD/OPS/IPRA/COPA.
In that regard even Staples is clean. She isn’t acting as an administrative supervisor on those scenes. She is supervising the criminal investigation, which we ALL (even Foxxxxx and COPA) agree does not exist here.

I don’t see any evidence provided by COPA’s report that disputes the version of events provided by those officers. Except an out of the blue withess never interviewed by police or detectives. The ‘witness’ was with a guy who was murdered but he doesnt know his name. So they dont attempt to prove that male existed or that they were together that night and then he was murdered? Very convienent. That witness testimony is probably proven false during a criminal investigation, certainly not taken at face value to become the center of the case as with COPA.

It states COPA did a two year investigation. COPA has not been around that long.

It further states investigator interviewed plenty of witnesses. But they did not.
They took statements from other investigations including civil suits.

This was a whitewash.

They allege that he failed twice to provide medical assistance. Ambulances came on scene and transported people to hospitals.

So, are police now required to do alot more than that? How much more exactly?

Are police to receive additional training and equipment to treat gunshot wounds amongst other things? What about exposure to infectious diseases?

Are police going to be immune if a person dies after police try to give medical assistance?

I read every page of that COPA Report. IMHO, it's unmitigated HORSESHIT!

What I found sort of funny (not ha-ha funny) was the repeated use of the phrase: ......
----> 'what a *reasonable officer* would do'. <----
I couldn't help but think back to Ex-FBI Director Jim Comey's press conference where he ::cough-BS:: exonerated :: cough-BS:: Hillary Clinton by saying: No *reasonable prosecutor* would press charges ....

As we found out immediately after Comey spewed that bullshit on national TV, the definition of 'reasonable' is 100% subjective. It wholly depends on whose Ox is being gored, and who is doing the goring.

The truth is that this "reasonable officer" standard COPA is using is just as subjective, it all comes down to who is determining what that means. And in COPA's case I think it's pretty clear -- In Police Shooting cases COPA will NEVER find that mythical 'reasonable officer' because in their anti-police minds, NO shooting is justified.

Last but not least, COPA's 'Preponderance of evidence' standard for guilt is a bunch of steaming crap. Every case they look into will be nothing but a modern day version of Stalin's Soviet Show Trial.

But hey, it's Chicago. Nothing could be more fitting for Tiny Dancer, the anti-police democrats, and the hood-rats Rahm's pandering to for votes.

I remember to this day, my dad on the day I was going to Join the Marines in 1967. He was a decorated Marine from World War Two and never talked about what he did or seen while Island hopping. But that day, he said, this Vietnam War is bullshit and not a treat to us like the Japs and the German's were in the 40's. Just before I was leaving, my dad said, if you don't have to go, stay out of this one. Well I joined the Marines in June 1967, I don't regret being in the fight, but thinking about what he said, it was true; there was no direct threat to our Country, it was all bullshit.

Signing off on the McDonald case sure did not hurt the current superintendo, did it? The real question awaiting an answer here is what is the discipline recommendation by COPA that is sure to follow and will CPD go along with it, resist it or let it go to the board. There are a lot of unanswered questions here to include what Foxx will now do.

Not because they were power hungry but because they genuinely cared about and wanted to help people. I tend to believe that the majority of people who can do this job want that. Very strange that a gsw (gsw 1) to the elbow that obviously was in the bent position, like when about to swing a baseball bat, is never mentioned again.

The Chicago Police Department Case Supplementary Report- Morgue Report, RD#
HZ103710, submitted by Sgt. Andrew Schoeff on March 21, 2016, documents that on December
27, 2015 Dr. Escobar performed an autopsy on the remains of and determined
the cause and manner of death to be multiple gunshot wounds (MGSW) and the manner being
Homicide. An external examination revealed GSW numbered #1 entered the left inner elbow and
exit the left inner bicep, GSW numbered #2 entered the left ribcage and lodged,

AND THEN..... a year an a half later.

In a statement made to IPRA on August 29, 2017, Assistant Medical Examiner ("ME")
Dr. Kristin Escobar stated that she performed the autopsies for both and
Dr. Escobar indicated that suffered six gunshot wounds to his body. The shot numbered
"1" was located on the lateral left side of the chest. The shot numbered "2" was located on the
lower left side of his back. The shot numbered "3" was located on his right buttock, and the shot
numbered "4" was located on the posterior medial left

Ironically right before COPA comes to light, a significant gsw magically disappears. Hopefully the PO's attorney sees this or was already aware of it

The JVD witch hunt saw McNaughton run for the hills. He wasn’t even 50 years old and should have been promoted a couple more times. Not to mention a Lt and some Sgt.’s. Time will tell. Sorry, I left this same comment (or at least worded pretty close) on an earlier post when I meant to leave it on this one.
Reading the full COPA report one thing stands out like a sore thumb----these Officers had just been in the WORST experience that an Officer can ever have, that of taking another person's life, topped with the accidental killing of a bystander.
A lot of the COPA comments could have been avoided by following the rule we used in my department in Nashville, Tn. We were represented by the FOP and the FIRST thing that the responding Officers did was to make sure the Officers involved did not develop diarrhea of the mouth----TELL THEM TO SHUT UP! Then call the On-call attorney and have them respond to the scene. A VERY short statement to the first Officers or Investigators, enough to have them look at what they need to, is ALL you say before you speak with a lawyer.
Once that attorney speaks with the Officers then they can make an informed decision as to when they will make a formal statement and where.
In these situations (shooting, fatal or very bad wreck, violent assault, etc.) time will slow down or speed up, you cannot be sure of distances, number of shots, commands given, who did what or to who. It may take days to remember it all.
Once you make the formal statement (whilst keeping your mouth shut to ALL of your fellow Officers) then you are "one and done". You make ONE statement and then you don't speak of the incident with ANYONE unless your attorney approves it beforehand.
I spent 37+ years on the job and worked Patrol for 28 and Detective for 9. This is how it was set up to avoid what COPA is hammering Officer Rialmo on----- "inconsistencies".
Avail yourselves of the same rights that everyone you deal with has, that of an attorney being present and the right to remain silent. Don't put the noose around your own neck.

Blah, blah, blah... If the officer felt his life (or someone else's life) was in danger of death or great bodily harm, both possible with a bat, then deadly force is permitted.

After reading the report, the victim officer stopped shooting after it was evident the offender with the bat was incapacitated. The law doesn't say X# feet= safety, it says "felt" life was in danger.

COPA saying they conducted a two-year investigation is like the fresh, know nothing PPO with exactly two days on the street telling people they've been a cop for a couple years in the hope of disguising how little they actually know. Instant experts, just ask them.

Yes, absolutely the truth. There was one sergeant, close to Daley who was made district commander then deputy chief, retired and made head of security for the CTA and McCormick Place now a police chief in a Madigan controlled suburb. That is clout. You cannot make this stuff up. Qualified? Maybe, but lots of clout leads to great jobs which leads to great qualifications

COPA really reaching trying to establish PO’s position when shots were fired. They make selective inferences which support their version of events and discount as not plausible anything that might not support their version. Very obvious. They also make a big deal of minor inconsistencies when it is common knowledge that recall is never perfect.

Avoid as much contact as possible and if you must make contact make sure your camera is running. It could end up being your best friend.

Citizens of Chicago you are on your own.

COPA claims that it found that Officer Rialmo is guilty of Allegation 3, firing into a building b/c
"Allegation 3 is that Officer Rialmo fired multiple times into a home occupied by persons who would be at risk of injury or death."

But CPD use of force policy is: "Firing into buildings or through doors, windows, or other openings when the person lawfully fired at is not clearly visible, unless directed at a specific location and such force is reasonably necessary to prevent death or great bodily harm to the sworn member or to another person."

The assailant was "clearly visible", in fact he was standing a few feet in front the officer and was not in the home but outside the home on the porch.

COPA Investigator used lots of verbiage and made many assumptions..Very subjective assumptions..Lots of twisted semantics.. Just remember that these COPA Goofballs will use everything they can to find you at fault no matter what the facts and evidence are...
