Consent Decree "Close"

And the countdown to unplugging the life-support machines is entering into the final seconds:
  • Mayor Rahm Emanuel’s administration and Illinois Attorney General Lisa Madigan are close to unveiling a proposed court agreement intended to govern reforms in the Chicago Police Department, attorneys said Friday in federal court.

    The lone sticking point, attorneys said, remains whether the department must document incidents in which an officer points a gun at a person.

    Attorney Cara Hendrickson of Madigan’s office said the parties have been “intensely negotiating” and reached consensus on most of a draft consent decree spanning more than 200 pages that covers topics including use of force, training, supervision and officer accountability.

    Hendrickson suggested the draft would be released to the public soon but cited no specific timeline. She also indicated that the draft could be released before the remaining issue is decided.
We already linked to the Fox News article that had some of the pages. We're have a lead on getting the entire file. We'll see shortly. This really ought to be a wake-up call to anyone still chasing. The documentation aspect of these "agreement" is only there to screw you in the event of a complaint.

I thought that the reason the federal consent decree was a no go, was because the feds wanted the city to disclose “merit” and what and who defined that qualification? It’s shocking that that doesn’t come up or matter at all in this nonsense democratic machine consent decree.

After O'Brien St, I started my CPD career in bloody 011 during the '60's.. Despite constant street stops and felony arrests, I consider myself blessed because I never shot anyone. However, on virtually all street stops, I held my primary weapon drawn and pointing downwards as I approached the vehicle, even with a smile on my face. There were several close calls where the armed occupant(s) saw a flash of blue steel in my right hand.

I was polite and respectful but any wannabe cop killers got my subtle message: Don't even think about it, muthafucka!

A "Consent Decree" is a complete death sentence for the already fully genocidal Black Community. As an African American Officer living in a once stable "Pill Hill" I am terrified for my 9 & 11 yr old sons and nephews. The already decimated CPD will be neutered and it will be wholesale slaughter and my already fragile neighborhood housing value will plummet further. When will Black America wake up to realize that the Democratic Party is STILL the party of the KKK but now mockingly represents the interests of Black America. Wake up Brothers!

I work at a west coast DOJ infested agency. The thing you're missing here is how the paperwork DOJ inflicts is so onerous as to change the way cops police. You think you're fetal now...

In my agency the definition of "force" was recently changed to include "force against resistance" and "resisted handcuffing". For example, you move in to arrest a guy, he pulls away, you grab him and pull him back to you while you wrestle him into cuffs. Everyone stays standing, no injuries, no nothing. That isn't a single use of force but two. What used to be an extra line (maybe) in the report now is a couple of hours for each officer plus a supervisor spent explaining which de-escalation techniques were used and why other options were not employed. If you didn't give a force warning before using force, too bad, you'd better get creative with what happened. Yes, you will be found out of policy if you don't warn the guy who has not yet resisted that if he does resist force (explicitly explained) will be used against him.

The big bosses say it takes so long because cops are writing too much. Meanwhile the middle management is kicking back reports due to lack of details. If any supervisor approves a force event as in policy and someone higher up disagrees, everyone who signed off is subject to discipline.

So, if you dare to arrest a guy who needs arresting but he struggles a bit, you're now down two or more cops plus a sergeant for a couple of hours. Meanwhile the rest of your team is stuck shagging your calls.

I personally opted not to arrest 3 people this week due to the policy. I had some bad luck and had accumulated two uses of force in my first two shifts of the week. If you get three in a three MONTH period, you are on the early warning system for abusive policing and get a notice. A few of those and you have real disciple. It's a slug's dream, but for anyone who thinks that criminals need arresting, it's not a winning formula.

If I were an officer in modern times I'd WANT to document any interaction with criminal scum. Better to spend duty hours in the station typing my story than to get blindsided by an ACLU lawsuit and have to try to document it all after the fact, when it will seem only like CYA activity. If that means I spend more of my shift documenting than actually policing, oh well. Got to look out for myself and my family before the "community".

Yes will give you examples of bosses who were not liked but who got the job done! John Townsend, John Corliss,and in 008th district the famous Harley Schinker,many coppers did not like them but they feared them as they backed us up and got the job done!

Corliss was WC in the district I was assigned to straight out of the academy. He called my name at my very 1st roll call and I boomed, "Here sir!". Then, realizing I was a PPO, he said , "Uh, wait a minute" and decided who was going to be my FTO, and then recalled my name. I responded, "Still here, sir!". The room which was already silent, waiting for the explosion, but then, without skipping a beat, he went on to call other names. Priceless!!!

Worked with Harley in a unit, and I'll give that asshole this much credit, he told me what he wanted in my area of responsibility, and I did my job without him looking over my shoulder, and that was that! Gave me control and I took it by the reigns and never heard a peep out of him. His tag along Lt. was a J.O. and you, who know, will agree with that.

New Orleans with sworn size of 1100+ paid 40mil for 4 years.

If we get a consent decree, the provisions of the contract are not worth a thing. COPA will have a field day with all of the power that is granted to them by the decree.

Why are they doing a consent decree when the DOJ said they would not be pursuing one? When will the endless pandering to the parasite class end. They make up 13% of the population but account for the majority of the time in America and WE need a bullshit consent decree. Let's just set a aside a state where they can live, with room to destroy. I'm sure the rest of America would be happy to support this type of arrangement. I would happily have money deducted from my paycheck for this. They can live as they please.

Between this and the reaction to the, in my opinion from what has been publicly reported, justified use of force recently in 003, how could we in good conscience send these newer officers out to our most violent and chaotic areas to stop suspects given that it appears they will be given no benefit of the doubt and punished for any unpopular outcome. Many do not yet realize that they have to do this for 20, or 29 years and a day, and all of that risk is cumulative. One incident in an instant can ruin their lives forever. Risk from violence is something I accepted, risk from unreasonable politicians when I did my best to follow the rules I did not. My instincts to try and help others and seek justice do not serve me well in this dysfunctional brave new World we are creating.

If we get a consent decree, the provisions of the contract are not worth a thing. COPA will have a field day with all of the power that is granted to them by the decree.

The city can already grant Copa any powers they want to. There's no need for a consent decree for that. And legal provisions of the contract can't do over written by a consent decree.
