J-Day Thursday

A jury might be seated by the end of the day, so it's decision time:
  • It’s the most crucial strategic decision so far for Jason Van Dyke’s defense team — and his lawyers could be forced to make it as early as Thursday.

    Should they put the fate of the indicted Chicago police officer in the hands of the jurors they’ve spent two days questioning? Or should they ask Cook County Judge Vincent Gaughan to decide whether Van Dyke murdered Laquan McDonald?

    That decision looms because 10 of the 12 jurors who would hear the case have now been chosen. Five were picked Wednesday — a black woman, who is the first African-American on the jury, a white man, a white woman and two Latina women, one of who is applying to be a Chicago police office and wanted to be a cop since she was 12.

    On Wednesday, when Dan Herbert pressed the judge about their deadline to make a decision, the judge told him, “when we get to 11, you’d better make a decision.” The judge soon relented, and said he’d give the defense team a night to think about it.

    They fell one short of 11 jurors Wednesday, but one more pick could put Van Dyke’s lawyers on the spot — especially if it comes early Thursday.
The Department is also finally making some decisions. An order came out that from 24 September onward, all elective time off must be approved, not by a Deputy Chief as has been past practice, but by an actual Bureau Chief. This is on top of the manpower counts that every District and Unit had to submit this past week for the remainder of September and all of October.

Definitely an interesting jury being seated so far though.

This jury is a joke!!!


Bench trial all the way. APPEAL APPEAL APPEAL. This judge will own his decision. Guilty, rioting and looting. Not guilty rioting and looting.

VanDyke gets a lot more than 16m. And he pays his taxes. He had a job, a career, a family.

I'd love to see tiny dancer, Jmac, and kidney bean in front of the jury. Pffffft.


APPEAL.

Bench trial. Not a Cop.

Not one of these orginezers knew this man. The system failed him, his parents failed him. He was an out of control drug addict. He made bad decisions that ended his life. Sorry, not sorry.

This is to all the Great men and women of the Chicago Police Department, No matter your opinion, please hold judgment until ALL of the evidence comes out.
Officers just remember #1 thing, Innocent until proven guilty.

There are always three sides to a story. For the last four years its been much of news paper reports and the media news outlets, side. Which is very little information that the media spins, causing more questions then answers and creates conspiracy theories.

As every Officer knows, there's always more then what the media is welling or able to publish and present. Thus, wait for the evidential facts in court. Officers' think about your own families, children,parents other loved ones. The impact of your career. What you have chosen, that being possibly giving up your own life during a tour of duty. And never returning home, rather allowing a total stranger to in fact make a safe return home. That's the thin blue line. Sacrificing your life for that of another.
Its not a job its a calling. Without consciously thinking about it you run into burning building and toward gun fire.
Just ask the Gold Star Family Members, about their lost loved one. There are 582 on the wall. Not included are also Officers that died while in the military.

So this calling works in mysterious ways, you just never ever truly know ! But judgment should never be past until all is known.

To: Jason and Tiffany YOU are Loved !!!!!! your children and extended family are thought of by many people. Van Dyke family you are loved. Also a great amount of thoughts go out too Jason's dad, who has been by his son's side everyday at court since the indictment.

No doubt about it the McDonald family is suffering as well,in this very difficult time prayers and thoughts of comfort for them.

Finally Fuck You Rahm !

The department (again) further strains exhausted and mentally drained officers who now cannot decompress from working this job with a day off......for the length of the JVD trial. Soon, they’ll be cancelling RDOs

Defense attorneys soon hit back with their own complaint after prosecutors used a peremptory strike to cut a white man who said he's close friends with many police officers and has seen dashcam video of Van Dyke fatally shooting McDonald ("Everybody has").

Rueckert noted that four of the state's five strikes have been for white men.

"How can you be more honest than this person was?" Rueckert asked. "He said he talked to police officers, but not about this case. I don't know how you can ask for a more honest juror. He's being challenged only because he's a white male."


There goes your chance for a mistrial. Take the bench trial and appeal.

The judge was previously arrested by CPD. Why on earth would they even consider picking him for a bench trial. It will be a jury trial and I believe that the city will go up for grabs following the verdict, however it goes.

What's worrisome is the prosecution is going to bring in other cops who were there and who investigated this incident. Some forcibly retired due to this incident. Their statements can put them in serious jeopardy of being charged with a crime, too, unless deals have been made for immunity.

Another Rumor I heard in the elevator at 35th street, is the Department will have us on 24 hour shifts like CFD. The city has secured a large quantity of Bunk beds from R J Vanecko bedding supply company. The department will erect large tents purchased from Daley and sons outdoor tents. These tents will be put up in the station lots and officers will be on 24 hour shifts, sleep for 12 and back on for 24.

Van Dykes lawyer already lost one jury trial for a Chicago Cop. There is a reason that 98% of cops charged with a crime take a bench trial and its because the judge has to follow the law. The US supreme court has already ruled on a case where an officer shot a woman with a knife and killed her. The court ruled the cop was justified and that cop had less of a reason to shoot her than Van Dyke had.

Herbert needs to get the point across to the jury (or judge) that lethal force was legally justified. Less than lethal force is never an option when an offender is armed. Yes, LM was armed. It can't be determined whether it was the first, or the 16th shot that ended his life. If the first shot was legally justified, there is no case. If there is a bench trial a directed verdict of not guilty would be appropriate after the state presents their evidence.

If we follow the rules and law you will have a jury of your "peers" so that would be police officers and other first responders, those are the peers and also people that believe in and respect "law and order" which are rare to find in this criminally infested democratic "we hate the police" most corrupt city-state-county in the entire country!

You need to look at the vid really closely. You'll notice that LM's path crosses at an angle to the right over the centerline as he passes JVD. But then for whatever reason he wobbles back across the centerline towards JVD at which point he opens fire.

As a P.O. who never had to fire my weapon in the line of duty, I consider myself fortunate. JVD, if you are reading this, just know my thoughts and prayers are with you and your family. Since i do not trust the court system here, I also pray that judge Gaughan presides in a fair an unbiased manner.

Can JVD be found guilty of a charge lesser than Murder like manslaughter or involuntary manslaughter. or does it have to be Murder or nothing? I know they added 16 counts off Agg Batt but that seems ridiculous. Anyone know?

Way too many ordinary people have a political agenda they follow openly or hidden.
The entire incident is a political circus to showcase a mediocre courtroom savvy from KimmFxxxUp.

I’d lean towards a bench trial.
The judge is smarter than the lead ASA and KFxxUp and will recognize the biased trick bag tactics she will try to introduce.
She has no case, confused jury is her best hope.
It’s not likely at all that DrRevSpecial Ed PhD gets called to the stand for the either side, as he will throw everyone and anyone under the bus.
He may even fall out and have some medical relapse sometime soon.


As for the violence prone feral packs, just another reason to wreak havoc.

It’s all about how it’s presented! What most people have been lead to believe, whiteman, shoots blackman! All the other people around there were afraid to get out of their cars or they just had their heads up their asses. The Officer reacted as he was trained. The deceased, unknown at the time, was on PCP, and had a knife, which he did use to cause damage, and was a threat. Someone called 911 because they thought that the offender was a threat. In training, you are taught that you deal with the threat until you are sure that there is no longer a threat. You see through a camera but you don’t see through the Officers eyes. If you can make that judgement, than your a better man than me. I thank God that I wasn’t put into that situation! Now he finds out who his REAL friends are....

Coincidence? The Rodney King case and its riotous aftermath was on cable last week. Also, the aftermath in dealing with the Baltimore uprising is also fresh in people's minds. No matter how you spin it, there is no way 16 shots will be justified. Coppers, McDonald is gone and you have to move on. If you want to stay on the job and survive in the present environment, keep your head in the game and decide if every move you make "is worth it".

A GoFundMe for his wife and kids should be set up at this point so they can change their last name and be taken care of (before even more public opinion turns against them).

--- I've said it before and I'll keep saying it; This third world rotten department does not give 2 shits about you or your family, unless you're the connected few. Believe me when I say that they would rather see you shoot yourself than shoot someone else, even when justified. Every rule, general order, and policy written down is to the benefit of the department and created for the sole purpose of reducing their liability from you and your actions. When an officer is killed whether it be by a criminal or his own hand, it is all nothing but useful fodder for the politicians and officials to get some great PR coverage on the news. They use every single one of these events as an opportunity to grandstand and display all manners of feigned sorrow, support and homage for another fallen hero. It is interesting how quickly these same public figures would distance themselves from these same heroes, denouncing their actions and promising swift and severe repercussions if the situation were turned around and the officer used lethal force to save himself or someone else, all in the name of "justice". As someone pointed out before, it is crystal clear how much a police officer's life is worth compared to that of a criminal. The families of police officers do not get million dollar settlements from the city they get killed in the line of duty, but the city has payed millions to criminals and their families.

I don't get the change of venue after a jury is picked. Take a Cook County jury to Peorea or some other location and you still have jurors who have been saturated with Chicago media coverage. Move the trial to Peoria with a Peoria jury, and give him a fair chance.

Three alternates were selected Thursday afternoon. Among them was a woman in her 50s who works for Cook County Clerk David Orr. She said police officers have difficult jobs and that she was intimidated by protesters outside: "You don't know what to expect. You don't know what they're gonna do."

I thought the judge said he would rule on change of venue DURING jury selection......if there is no change of venue, and Officer VanDyke is found guilty of anything, there HAS to be an automatic appeal......there is NO city WORSE than Chicago where the police department has been painted by the Mayor, the MSM, and the "community" as evil, racist and a genocidal gang of thugs......evidence and statistics be damned....

Even my old fat ass can run across 21 feet in a second or two with a knife in my hand and kill or maim someone......the future brain surgeon was high on PCP, had already committed numerous forcible felonies, and was a threat to anyone nearby, be they citizen or cop.....his own mother refused to raise him......
The only portion of video shown over and over ad nauseum does look awful to an uneducated observer......but this trial is not the slam dunk the MSM believes it is.......but I don't know if ANY juror has the courage to vote not guilty in this city.......and for sure, no bench trial.....after his rulings in this case, I believe that would be a grave error on the defense part.....

I know more about the Judge than you,take it to the bank. If they go for a bench trial they will get the proper verdict with the evidence presented.
Judge Gaughan is a Vietnam Combat Vet. ( Volunteered for the first Special Forces group authorized by Kennedy),grew up a tough Irish Catholic kid in what is now the DePaul area of the city.He is far from a Police hater. He Can be your best friend or worst enemy depending on your Knowledge and competency.The defense atty needs to learn that the Judge does not suffer fools on either side. He will take the evidence presented,add in the law and make the correct decision,he is beholden to no one and doesn't give a rats ass what anyone "thinks " he should do.
Anyone who has been in front of Gaughan will tell you he is an arrogant crabby SOB to everybody but no one will accuse him of being corrupt or incompetent.
PO V. biggest problem in Gaughans court room during a bench trial would be the Attys he hired,They don't appear capable of putting forth the proper defense.The defense Attys. need to bring their A game and so does the other side,Gaughan will take no shit from either side.

While I'm a nobody, I think he should go bench trial. If the jury is truly going to be impartial and there is an actual chance he will win, he should still do a bench trial. It's unfortunate but those 12 people's lives are ruined if they come back with any verdict besides guilty of first degree murder. I know its his life hanging in the balance but if it were me, I'd wouldn't want to burden the jurors with the hell they'd face just for doing what's right.

When are people going to realize that Fox and the Cook County States Attorneys have nothing at all to do with this case. McMahon is a Special Prosecutor. This case was taken out of the hands of the Cook County States Attorney when Alvarez was still in office.

Every rule, general order, and policy written down is to the benefit of the department and created for the sole purpose of reducing their liability from you and your actions. When an officer is killed whether it be by a criminal or his own hand, it is all nothing but useful fodder for the politicians and officials to get some great PR coverage on the news. They use every single one of these events as an opportunity to grandstand and display all manners of feigned sorrow, support and homage for another fallen hero. It is interesting how quickly these same public figures would distance themselves from these same heroes, denouncing their actions and promising swift and severe repercussions if the situation were turned around and the officer used lethal force to save himself or someone else, all in the name of "justice". As someone pointed out before, it is crystal clear how much a police officer's life is worth compared to that of a criminal. The families of police officers do not get million dollar settlements from the city they get killed in the line of duty, but the city has payed millions to criminals and their families.

How do you not know by now that Foxx's office has nothing to do with this prosecution? VD was charged by Alvarez and is being prosecuted by special counsel - not CCSAO ASAs.

As for the change of venue, VD's lawyers fought tooth & nail to change the venue; they even brought in an expert to testify that it would be incredibly difficult to seat a fair jury in this current climate. Gaughan held off on his ruling until Herbert made a decision re: bench or jury. I don't think VD/Herbert HAS TO make a decision up until the 12th juror is seated, which likely will be today (Friday). At that point, the judge said he'd rule on the change of venue motion if VD chooses a jury.

While I'm a nobody, I think he should go bench trial. If the jury is truly going to be impartial and there is an actual chance he will win, he should still do a bench trial. It's unfortunate but those 12 people's lives are ruined if they come back with any verdict besides guilty of first degree murder. I know its his life hanging in the balance but if it were me, I'd wouldn't want to burden the jurors with the hell they'd face just for doing what's right.


Wouldn’t worry about burdening the jury. They chose to be on the jury for whatever reason. Anyone who didn’t want to be on that jury had 100 ways to be excluded. If you put on the questionnaire you thought he was guilty or thought he was innocent you were excluded. If you made it to the questioning part the judge asked if you could be impartial and not let you feelings enter into your decision, all you had to do was say you couldn’t and you were excused.

Both of the 2nd watch Lieutenants in 007 hit the medical for NATO. Both have since been promoted. One is a DC (NS) and the other is a grossly overweight Capt.

That’s the way the CPD operates. If you are heavy, pardon the pun you can do as you please if you aren’t and try to get into a unit or merit they will say you have been on the medical twice in 10 years and eliminate you. Nothing new here

I had a case years ago where an elderly couple were driving in the wrong direction and got into an accident, and I talked to the desk Sgt who suggested I just drive them home. Their car was totaled, it was a very old car, but they were ok. I don't know would if sgts nowadays would let you do that, but they should.

Anything is possible, but I do not see him getting his job back, and even if he did, how would he work the street? I don't know ow what he will do after this trial, but I am sure this is a financial hardship. And for the record, I wonder if, as an earlier poster said, this kid was failed by his family and the system.
