Damage Control = Warrant

  • An arrest warrant for murder has been issued for a man in connection with the death of a cabdriver who died after being kicked in the head during a traffic altercation, court records show.

    Anis Tunkegar, 64, died on Sept. 4, two days after he was kicked in the head following an argument with another driver on the Near West Side.

    The driver who allegedly kicked Tunkegar was taken into custody after the incident, but was released two days later without charges. Some time after his release, he went to China, according to Chicago police spokesman [Google-me].

    Cook County Circuit Judge Edward Maloney on Wednesday found probable cause to detain the other driver and issued a warrant for the arrest of Lu Fangqi on a murder charge.

    Tunkegar’s family, though, fears it may be too late and that the man may have successfully found refuge in China.
Someone commented that Prickwrinkle is noticing the incompetence of her hand-picked States Attorney. It's all well and good to reward your political ass-kissers, but at the same time, they have to actually have a tiny modicum of ability (or surround themselves with a few competent people) lest they embarrass the boss. Foxxx has neither ability nor competent people in her office.

According to cwb, a “police executive” is responsible for pursuing the warrant. Who had the balls to do that? I’d say Staples, but the son refers to “his own hands.”

Fortunately, the world is starting the catch on that Kim Foxx is no more qualified to be the Cook County State’s Attorney than she is to step into an operating room to perform brain surgery. Her time as an Assistant State’s Attorney was undistinguished in virtually every way. She spent her entire time in juvenile and almost never touched an adult case. She was transferred to the Criminal Prosecution Buerau for a brief stint but when it became apparent that even that was way beyond her capabilities, she was pushed back to Juvenile. As a lawyer, she’s inexperienced and incompetent. As a politician, she’s a cheap carnie hustler who can talk a good game in short left leaning sound bites (although that might be an insult to cheap carnie hustlers). She lacks substance or depth. She is reviled and ridiculed by the other elected State’s Attorneys through Illinois. Sadly, at the end of the day, it’s the people of Cook County (the their neighboring counties) who suffer because someone like Foxx who has no business sitting in the seat is there. And finally, the only reason she is there is because of Preckwinkle and George Soros.

The fact that Kimesha's prior work experience was confined solely to an entry level position in the Juvenile Courts (where many new hires are placed until they prove their competence for bigger assignments) struck me as proof positive that she was not highly regarded by her superiors who saw her as an untalented political patronage hire unworthy of a promotion even after years of employment. During her successful campaign, she lied about her prosecutorial experience and claimed that she was so committed to juvenile justice that she chose to stay put. The office of the Cook County States attorney has been a problem for decades. Nothing new here, except that it looks like Foxx is taking the problem one step further in an attempt to keep down the black and brown population in the jail and court system. Preckwinkle was on board with that and openly made comments to that effect. So, I don't believe these " rumors" that Preckwinkle is upset, at least not to the point any changes will be made. Besides that, I don't believe most of the public really pays attention to this. They blame the cops for the crime rate, not the prosecutors and judges, or for the Illinois prison system for that matter which plays a big part.

A keen observant and tenacious tactical warrior is able to catch/collar/nab him double parked in his cousins borrowed Uber at the courtesy exchange, he now has his affordable bail and hopefully it’s not accidentally inventoried for goodness sake.

Seeking a warrant is not the same as prosecuting a case. What do you think happens when you advise warrants on a call? In this case, when/if the offender is arrested on the warrant, charges will still have to go through the SA's office for approval and prosecution. Getting a warrant alone is not prosecution. Judges don't need the SA's office for that. Perhaps you should learn a thing or two and get your head out of your ass.

(a) When a complaint is presented to a court charging that an offense has been committed it shall examine upon oath or affirmation the complainant or any witnesses.
(b) The complaint shall be in writing and shall:
(1) State the name of the accused if known, and if not known the accused may be designated by any name or description by which he can be identified with reasonable certainty;
(2) State the offense with which the accused is charged;
(3) State the time and place of the offense as definitely as can be done by the complainant; and
(4) Be subscribed and sworn to by the complainant.
(c) A warrant shall be issued by the court for the arrest of the person complained against if it appears from the contents of the complaint and the examination of the complainant or other witnesses, if any, that the person against whom the complaint was made has committed an offense.
(d) The warrant of arrest shall:
(1) Be in writing;
(2) Specify the name, sex and birth date of the person to be arrested or if his name, sex or birth date is unknown, shall designate such person by any name or description by which he can be identified with reasonable certainty;

(5) Be signed by the judge of the court with the title of his office;

(8) Specify any geographical limitation placed on the execution of the warrant, but such limitation shall not be expressed in mileage.
(e) The warrant shall be directed to all peace officers in the State. It shall be executed by the peace officer, or by a private person specially named therein, at any location within the geographic limitation for execution placed on the warrant. If no geographic limitation is placed on the warrant, then it may be executed anywhere in the State.
(f) The warrant may be issued electronically or electromagnetically by use of a facsimile transmission machine and any such warrant shall have the same validity as a written warrant.

Completely wrong. ASAs do not obtain the warrants. Officers and detectives do. The entire Felony Review system is an agreement between the departments, it is not law. Our exempts can override them on any charge but they rarely do because the ASAs throw a tantrum and nolle the case out of spite.

The cook county states Attorneys office is one of the main reasons Chicago is as awful as it is. They don’t approve felony charges unless it is a slam dunk case and yet their ASAs still lose cases. These ASAs act smug and look down upon us, but at the end of the day they only have a job because we do ours. It is our hard work, our cases, and our safety on the line. They love to talk big about “this case or that case” of theirs, yet they’ve only read paperwork on the incident, we put in the sweat. I’m glad this judge realized the nonsense felony review was pulling and approved the warrant, even if it is only symbolic since this guy is never going to be turned over.

While Prosecutors enjoy broad discretion in what and how to charge, they still have to abide by the Constitution. Equal protection under the Law, Due process, etc.

If you charge one person for murder for kicking someone in the head after a traffic altercation (or even if not traffic related), you need to charge all so similarly situated.

In an abuse of Prosecutorial Discretion one can file a lawsuit, or even appeal to the Attorney General of IL. Let the AG bring the charges in lieu of the local Prosecutor - to ensure Justice is served.

Not protecting the rights of the victim is violating the Civil Rights of a FEDERAL Citizen (we're all dual citizens of the State and Federal Governments, and both Constitutions apply). That the Murderer absconded over State lines, and indeed outside of the Country makes this a Federal Civil Rights matter.

Some Federal Judge ought to compel Ms. Foxx to come to Court to explain herself. Nothing may come of it - but PUBLICIZE IT FAR AND WIDE. Make her unable to hide from this, and let her have an "out" by claiming that under "careful consideration of further information provided to this Office, the following charges are being conveyed against Mr. Attacker"...

This isn't some deciding whether or not to charge some dumbass kids for setting off firecrackers - someone got killed. There's VIDEO of it. WTF isn't she charging him? What's the reason?

Or are we now sending the message that along with tolerating shoplifters, we're going to tolerate murderers too...

I’ve personally walked warrants by speaking to the judge and getting them approved. It’s simply telling the ASA you want to walk a warrant, they tell the judge, judge listens to you and your PC and they either approve or deny. That’s it. The amount of blame the ASA’s take is ridiculous.

Good idea, but the problem is when the arrest on the warrant is made and on the initial court hearing all the ASA has to say they choose not to prosecute and the case is gone. A po or judge cannot make the ASA prosecute the case.

Foxx is a tool only. She is not even smart enough to surround herself with competent people. The only qualification she is interested in is a person's skin color. The good ASAs have either left the office or been asked to leave. There was a recent lawsuit filed against FOXX for the office environment she fosters.

The current ASAs are afraid to try cases. An investigative reporter could look into this. There are drug dealers who are dealing in kilo quantities of narcotics but Foxx's ASA are letting them go with probation or MINIMUM jail time. All because the ASA is afraid to try the case or maybe they just don't know how to introduce the evidence.

This same thing is true of gun cases and battery cases.

When are the people of this county going to wake up. Crime is NOT about skin color. Crime is about people not respecting the rules of society.
