Testing - One Two - Is This Thing On?

We don't even know how to calculate how much money Frank Main is going to owe the Chaplains after this article:
  • Closing more murder cases even though no one was arrested pumped up the high clearance rate the Chicago Police Department has touted, a Chicago Sun-Times analysis finds. The police department cleared more murder cases in 2019 that didn’t result in an arrest than it has done in years, the Sun-Times found.

    Faced with turmoil at the top, a new mayor and criticism in recent years that its murder clearance rate was lower than the national average, the department made a surprising announcement Dec. 31. Police brass boasted that the department had “cleared more murders than in any of the past 10 years.”

    They touted a 53 percent homicide clearance rate for 2019 — a huge turnaround after years of clearing fewer than one of every three murder investigations. They credited investments in more officers and in technology for “undoubtedly improving the Bureau of Detectives’ ability to clear more crimes.”

    But, of the 261 murders that the police signed off on as having been cleared last year, 152 were closed “exceptionally” — what the department labels “CCX” for “cleared, closed exceptionally,” meaning no one was charged. That means there was no arrest in 58% of the cleared homicide investigations.
We've been writing about this in one form or another since the beginning of the blog. McCompStat's entire career was built on falsifying crime data to the point a couple of ex-top cops in New York wrote the definitive book about it and teach come college courses regarding it.

Clear murders by blaming a dead shooter? Why not? He can't sue you for defamation, and what moron is actually going to step up and claim credit for a murder the Department has already buried?

Guess who's (mostly) to blame?
  • When someone the police believe committed a murder has died or when prosecutors reject murder charges, the police department’s policy is to clear those cases exceptionally. Chief police spokesman Anthony [Google-me] says the reason for the high percentage of CCXes last year is that prosecutors are rejecting murder charges more frequently.

    According to the Cook County state’s attorney’s data, prosecutors rejected about 25 percent of the murder cases the Chicago police presented in 2019, compared with 14 percent in 2015.

    There are reasons for that, says Tandra Simonton, spokeswoman for Cook County State’s Attorney Kim Foxx. A key one, Simonton says, involves an Illinois Appellate Court ruling in late 2017 involving DNA testing of semen in a murder investigation. That ruling has sharply limited the circumstances in which prosecutors can pursue murder charges. They’re now requiring more than just DNA evidence to file a murder case.
So we (CPD) know who did it, but Crimesha refuses/rejects charges and then relies on an Appellate Court ruling involving DNA testing semen? Do you know how many murders DON'T involve sex? Something like over 90%.  So where is CPD supposed to get this magical DNA? This isn't television or Hollywood - DNA isn't infallible evidence. Never has been.

Last night, a M/B approached a marked NYPD van with 2 officers parked at 906 Simpson St. in the 41st Pct. He asked officers for directions. Suddenly, he drew a gun and shot one officer in the chin/neck area and fled. Officer transported to ER. He's now in fair condition at Lincoln Hospital. No one in custody at this time.

I was a Homicide dick many moons ago. I’m happy you guys are keeping up with this. Just face it, there are very little investigative skills amongst the Homicide dicks and their supervisors. They need to hire seasoned retired dicks back and put them in the academy. My neighbor died by Homicide and his family hasn’t heard anything. I called the Area and they gave me the spill that they give the citizens. The old spin off. I’m still waiting on a call. I talked to one of my guys who is still on the job and he told me that nowadays the dicks wait until the victims or offenders dies and then they “Exceptionally” close Homicides. They hand carry the exceptionally closed Homicides to Deputy Jones’ office in the HQ. I couldn’t believe what I was hearing. Is that the goal?

We took pride in being Homicide dicks. We dressed to part. We knocked on doors and made arrests. We built relationships with the community. We received tips, clues and anonymous letters on a regular bases. Our investigations were so tight that bad guys would get word that we were looking and they would come in even if they brought a lawyer with. I tried mentoring a few before I left, but the new cats at that time seemed lazy. I’m not surprised by this at all.

Also when Foxx and her band of nitwit felony review Supervisors reject a case it will soon become a CCX- bar to prosecution case. This doesn’t mean this case can never be re-opened and presented later if more information or additional witnesses become available.

They call Homicide cases in that are not ready to be reviewed. Felony Review have to tell detectives to call them back once the case is ready. For example the encounter goes like this:
ASA: Detective do you have the rap sheet?
Detective: Give me one minute, I’ll print it.
Some detectives expect the ASA to do they’re investigations for them. An ASA cannot be a part of your investigation and they don’t have time to respond to the Area to supervise your investigation. Don’t call until the case is ready to be reviewed.

SCC, I can’t tell if you are being sarcastic or not with part of your comment. Are you seriously saying that it’s that hard to believe that some of the murders we investigate, sometimes the offender in that murder gets killed themselves, and we have built up a case against that shooter as if we were presenting it for charges, That we shouldn’t close that case? That it should remain open for ever? Let me tell you, for us to Exc Clear a case and get it approved on someone who is dead by whatever means is almost as difficult as getting a case charged. We re not just making up names. You still have to have a positive ID, video, third party statements , etc and it has to go up through your Lt, Commander, and then Deputy Chief, with a lot of them getting rejected. We re just not pinning cases on dead people for numbers. If I misread your comment, please disregard. It’s just hard for me to understand that you can’t understand that people that kill people don’t get killed themself.

Our cases are getting rejected because their office is acting like AUSA s office now. They won’t charge a case unless they know they can win. Instead or realizing that if meet our burden, have a built up a good case, they are taking the possibility of these offenders taking a plea , before trial, which is considered a win

One other thing that isn’t mentioned here, when we Exc Clear a case because we feel we have enough to charge, and the State doesn’t and rejects charges, yes, with approval of the entire chain of command we Exc Clear the case. BUT, if new evidence is brought forward later on which takes the case one way or another, That case is reopened. Should we let a case remain open forever when we feel it should be charged, the State rejects it, and there is nothing else to do on it?

Two victims.. visitors to Chicago were executed tonight in Chinatown. The offender was caught with bloody footprints shortly after the arrest with the gun around the block a few minutes after the murders.. it was apparently a robbery gone wrong. The offender caught a robbery for robbing several people about 16 months ago.. case still ongoing and then, caught a class 3 felony narcotics case 12 months ago. Both cases still pending trials and he’s out on bond. Did the states attorney ever argue at his class three arrest to revoke his bond??? Did the judge give him no bond for the robbery?? Why is he on the street??? Does anyone at cook count have any damn clue what’s going on because one of these poor people had to watch as this animal executed their spouse and was then brutally murdered themselves. The scene was absolutely awful and should be shown to Kim Foxx and the judges involved to see what the hell their policies are doing. Two good, normal people who just were living their lives until this predator terrorized them. Their last seconds of life were absolute sheer terror judging from the scene. I can’t take this anymore!!! How the hell can anyone just stand by and say that affordable bond and second, third and fourth chances are warranted because criminals may get hurt feelings from being locked up for their actions.. well ms Foxx and cook count judges and court system please come and look at the crime scene.. pictures won’t do it justice at all and you will maybe see what’s happening out here for your social experiment. I am absolutely heartbroken for these two people and their families. This could have absolutely been avoided if it’s true that these cases are still pending and that needs to be confirmed and if true it needs to be national news. I can’t imagine watching a my husband have to be murdered in front of me then know it’s me next all for a robbery then callously shot numerous times in the head.. Sad,sad, sad!

Wodnicki was having robbery detectives go over any cases years old that have passed the statute of limitations, reopening them, progress them and then ex clear close them for a 2019 clearance number. He thought his work by boosting the clearance rate was gonna get him made but then he went to Indiana. Whoops.

Their talking about People v. Escort, 2017 IL App (1st) 151247. However that case was about (at the time) a 22 year old cold case where all the state could prove was a) defendant had sex up to 72 hours before her death and b) he had 2 priors. That’s not a fact pattern you normally see.

I’ve been out of the game for awhile but here’s a news flash, and I’m guessing more so than ever under FOXX, the ASA’s office expects detectives to try the State’s Attorneys case for them before it gets to court. They don’t want a loss and they aren’t willing to put their effort into it on their end. Oh and by the way, not a Homicide case, but do you remember a little case involving a guy named SMOLLETT? Yeah, detectives handed the ASA a case on a silver platter and what did your State’s Attorney do with it? When you have a State’s Attorney like FOXX, who thinks she’s a public defender & actually works against laws on the books, how much reason & logic do you think actually goes on from felony review? I hate the number shuffling, but I honestly see the point in the CCXs. When you have a rejection rate up almost twice, not enough detectives and when you do get them- everyone is inexperienced all at the same time. The inexperienced detectives thing is going to happen more & more because almost nobody wants to get kicked around by the mayor, politicians, media and public for too long anymore. Experienced detectives want out. ASAs are immune from prosecution- detectives aren’t. You can do every possible thing right, but if a shithead witness lies to you or a baby’s mama flips years down the road, well, the detective’s ass is in jeopardy.

If the offender is alive you can’t ccx it without bringing them in and getting a rejection from the state. The state sometimes wants a “meeting” to review the case before being the guy in because god forbid the state only had 48 hrs to review the case, and there better not be any pending dna you have been waiting a year on. When a solid case is brought forth the state is hesitant to make a decision on the case. The state does not want to put on a case they would rather plea the case. Knock on all the doors you want with out crystal clear video, solid witnesses who will stay through the process, and or a confession good luck.

There is probably going to be more of these manipulative manners of clearance still to come.
A proper clearance is one by arrest and conviction that takes a criminal off the street for the prescribed sentence as written by the ILCS.
But with CookCo Sts Atty KmmmFxxxUp selective application of restorative justice with all its hoops and hurdles, the prosecution portion of the formula is null.

The entire CookCo States Atty Office has become nothing more than a clearing house (for justice involved individuals), shuffling and processing paper, then entered into a limited retention data system. Think of a ant farm with all that constant moving shit around, but never finishing or accomplishing anything. No offense to any actual working ant (formicidae hymenoptera) colonies.
The Rap Sheet will also become obsolete as will mugshot photo image.
Every repeat justice involved individual that comes before the states atty/court (in those rare instances) will be a treated as a first timer, as the past has been too divisive and disparate.
Watch for changes to Incident Reporting too, decriminalization and lessening felony definition will be rampant.

I believe every homicide, every felony case has the ability to be cleared the old fashioned way. No cooperation from the public is hardly the issue anymore. The trouble is having Prickwrinkle-LightLoafer-KmmmFxxxx in the way bumming up the works.
Next up could be that just a name will be sufficient for some sort of Dept asterisk clearance.
This of course Is the magic wand that gives GrootLoafer and next great historic superintendent the accolades and championing Crime Is Down™️ all over again.

This is some of the dumbest shit I’ve ever read. This is obviously someone who has never worked a homicide, you call it into felony review and speak to a civilian, who tells you a ASA will call you back shortly. When the ASA calls you back you tell them who you currently have in custody and why, the ASA says ok I’ll respond to the area, you don’t give them IR numbers over the phone for Homicide’s nemrod, when the ASA comes to the area you provide them with a packet with all the rap sheets of victims, witnesses and offenders, you also provide them with a copy of any completed reports. Most of the time as you build your case the ASA has already interviewed and locked in your witnesses prior to responding to the area for an in custody , unless the offender was taken into custody shortly after the homicide

What has the Dt division turned into, a babysitting service, we learned as working beat officers that before you call felony review you have everything that will submitted in hand, we were ready when we called the Area for a Dt on any case that needed a Dt and felony review, ie agg batt, robbery etc or even burglary which was a call in for the Dt or auto theft if the case could be proven as a felony.

I was a Homicide dick many moons ago. I’m happy you guys are keeping up with this. Just face it, there are very little investigative skills amongst the Homicide dicks and their supervisors. They need to hire seasoned retired dicks back and put them in the academy. My neighbor died by Homicide and his family hasn’t heard anything. I called the Area and they gave me the spill that they give the citizens. The old spin off. I’m still waiting on a call. I talked to one of my guys who is still on the job and he told me that nowadays the dicks wait until the victims or offenders dies and then they “Exceptionally” close Homicides. They hand carry the exceptionally closed Homicides to Deputy Jones’ office in the HQ. I couldn’t believe what I was hearing. Is that the goal?

This has nothing to do with the increase in murder charges being rejected. Because we all know Felony Review CIs every case that has more than one witness. Further, that bogus case that Tandra responded to the press about has nothing to do with the increase in murder charges being rejected. That's just a bunch of lies given to the press to placate them. Just read this insanity, but not believing it checked on the bill, its true. in the 70's I worked in a gas station pumping gas, then we had "mini-serve," where we pumped your gas but you didn't get windshield cleaned or tires checked and gas was 8 cents cheaper. Then self serve pump your own came into play which was 20 cents a gallon less. Back in day many gas stations had 4 pumps 2 with regular ad 2 with low-lead or unleaded, and we had 2 guys pumping gas, now look at the size of the stations,gargantuan now how many attendants will be needed? Like the post above "yea givs me that credit card," watch the fraud it will be epic. Now your for example a semi-driver your truck hold 100 gallons of fuel in each of the 2 tanks and your in a hurry, or the Goof pumping drops fuel all over the side of your ride, watch the fights with this!

Most of the people commenting on this have no clue what goes into a homicide investigation. Even the old timers who worked murders more than 10 years ago wouldn’t recognize the job, I’m sure you were good back in the day, but the rules are different now. The article has so many errors is sad.

CCX with a dead offender is reviewed just as if you were asking for charges. The investigation better be solid if you want it approved, multiple layers of approval are needed. These are rare, many times they are older cases where felony review dragged their feet on the case the first time around.

CCX by state rejected must have an offender arrested and a CB#. Any other county in the country and most of these would be slam dunk convictions. The ASA office is the reason for all this nonsense. They are horrible. Real life example, an offender can be on camera committing the murder, leave physical evidence like prints or DNA and the state will still reject it. They want three eye witnesses with no backgrounds who are willing to be dragged through the ringer by their inexperienced ASAs.

This mess is mostly the states attorneys fault. It is true there are many dicks who have given up, but this is a direct result of felony review continually messing up their investigations or just rejecting everything. Not every case can be wrapped up neatly with a bow, this city is a hellhole.

That was always the law. There was a California case in the 1990's that said statistical DNA evidence alone was not proof beyond a reasonable doubt. Fast forward to the early 2000's. The CCSAO charged a 7 year old cold rape case based on DNA that showed that the match that occurred could be expected to happen once in every six billion times. But in this cold case, the victim identified the wrong guy in the line-up and the victim said the now charged defendant did not do it. Case is going to a jury in a month. ASA calls the detective:

ASA: Could you find out where the defendant was on the date and time of the rape 7 years ago.
Det.: How do you expect me to do that?
ASA: Try investigation.

Several days go by. Detective calls the ASA.
Det.: We found the name and address of the defendant's girlfriend he was dating at the time of the crime and located her. We knock on her door and ask her if she knew where the defendant was on the date and time of the rape in question not expecting an answer. Instead the old girlfriend say "I know it well. That was the day I broke up with the defendant and he got real mad at me and stormed out of the back door that night." We ask her where she was living when that happened and she gives us an address. Our jaws drop. It was a block from the alley where the rape occurred.

The next day the ASA meets with the Public Defender and hands him a police report showing the defendants presence a block away just before the rape. The Public Defender calls him back later in the day saying it was a blind plea coming up and not a jury trial. The defendant got close to 20 years in prison on this rape his second such conviction.

I am a former detective who worked homicides on the West Side, decades ago. Yes, You are right. I probably would be lost in today's working environment. Lots of changes. But, some of the very bad changes would have to be; a social justice warier for a prosecutor, merit detectives and clouted detectives who cannot be dumped , supervisors who should not be in the detective division, and a host of laws and policies that hamper you and tie your hands, especially regarding witnesses. Then there is the fear of being sued and held personally responsible. I feel sorry for current detectives. I am glad I am retired and would not and probably could not do the job today. Politics has always been part of the job, but I think Daley the son brought things to a new height. Johnson really did a lot of damage.

The Cook County States Attorney’s office approve Homicide cases for other municipalities regularly. CPD often bring forth half ass investigations and expect charges to be proved based on hearsay. They call Homicide cases in that are not ready to be reviewed. Felony Review have to tell detectives to call them back once the case is ready. For example the encounter goes like this:
ASA: Detective do you have the rap sheet?
Detective: Give me one minute, I’ll print it.
Some detectives expect the ASA to do they’re investigations for them. An ASA cannot be a part of your investigation and they don’t have time to respond to the Area to supervise your investigation. Don’t call until the case is ready to be reviewed.

This is some of the dumbest shit I’ve ever read. This is obviously someone who has never worked a homicide, you call it into felony review and speak to a civilian, who tells you a ASA will call you back shortly. When the ASA calls you back you tell them who you currently have in custody and why, the ASA says ok I’ll respond to the area, you don’t give them IR numbers over the phone for Homicide’s nemrod, when the ASA comes to the area you provide them with a packet with all the rap sheets of victims, witnesses and offenders, you also provide them with a copy of any completed reports. Most of the time as you build your case the ASA has already interviewed and locked in your witnesses prior to responding to the area for an in custody , unless the offender was taken into custody shortly after the homicide

pretty sure the point was when the ASA comes to the Area the rap sheet is not printed out but I digress ... I can see the Detective not having everything done when calling it in because the state is going to come out and completely reinvestigate everything anyway ... re-interview witnesses , offender(s), etc. Hey State - that's NOT your job. This is what I've got state, now MAKE A DECISION. You don't need to talk to ANYBODY because I have ALREADY TALKED TO THEM. how about that state? Now go call your supervisor in some private room because you haven't a clue, then come back with some completely irrelevant question. It's called FELONY REVIEW not FELONY TRIAL.

Their talking about People v. Escort, 2017 IL App (1st) 151247. However that case was about (at the time) a 22 year old cold case where all the state could prove was a) defendant had sex up to 72 hours before her death and b) he had 2 priors. That’s not a fact pattern you normally see.

You are correct that she is relying on the Escort case to justify rejecting 11 percent more murder cases than her predecessor did in 2015. You are also correct that Escort involved an unusual fact pattern. Fact pattern aside, that case in NO WAY prevents Foxx from approving charges on a "DNA only" murder case (which we all know there are not many of). That's like saying because a murder case got reversed because the eyewitness ID sucked in that particular case, that Foxx could never charge an eyewitness ID case again, even if witness knew the killer and was standing 2 feet away in broad daylight. So, either 1) Foxx doesn't understand the basic principles governing when appellate court cases apply (or don't apply) aka precedent; and/or 2) she's just lying and using that case as an excuse to cover up the fact that she's charging fewer murders because she's soft on crime.

As far as Escort and all the expertise about this case. You forgot two rather big details in your summation. First, Escort denied knowing the lady or having sex with her and would later change his story that he did... that’s fine, however there is this, which until the appellate court ruling was a reasonable and sensible argument that the jury used to convict:

The victim’s underwear was lying right next to her... the victim had semen dripping out of her and all over her, yet there was absolutely nothing on her underwear. The state made an argument before 12 Cook County Jurors that there was a reason she did not have semen on her underwear. Because she was unable to put them back on because she was dead. His DNA was also under her fingernails. Despite a Cook County Jury finding this argument to be plausible... the appellate court tossed out the verdict and came back with a Not Guilty. If you think the Appellate Court was right, then you need to leave law enforcement and join the ranks of the criminal apologists and liberals shitting all over this city.

Completely agree with you that Escort was wrongly decided. It's one of the worst decisions out of the 1st District App Ct in recent years (and that's saying a lot) and resulted in a murder walking free to kill again. But even if you put the wrongness aside, the Escort opinion still does not provide a valid basis for Foxx to reject charges in a murder case. She once again is shifting the blame to another entity (the App Ct) just like she shifts the blame onto the police, the "old school" prosecutors who don't buy her BS, the FOP, Trump, systemic racism, etc. any time someone dares call into question her or her decisions. She is the worst thing to happen to the CC criminal justice system, which again is saying a lot when you look at the rest of the cast of characters. For those of you feeling the difference in your neighborhoods where you used to be safe, there is one person to blame... Kim Foxx... who has orchestrated a hostile takeover of the CC St Atty Office and filled it with employees who fit in better at the innocence project. Destroy from within. That should be her campaign slogan. At least that would be honest and "transparent."
