Screw Your Court Ruling

So the ruling against JB the Hutt applies to a single legislator, the one who brought suit against the governor for his overreach. So why is Jabba going to appeal the ruling in short order?
  • Precedent (not to mention everyone else can win now.) Other Courts take the finding into consideration. Conflicting rulings mean the State Supreme Court gets involved and if they rule against Civil Rights, the federal courts come into play.
  • After a judge in Southern Illinois ruled that a state representative was exempt from Governor J.B. Pritzker’s extended “stay-at-home” order, Chicago Mayor Lori Lightfoot says the city intends to continue enforcing the restrictions.

    In a press release, Lightfoot called Judge Michael McHaney’s ruling “troubling and wrong,” and said that she stands firmly behind Pritzker’s actions during the coronavirus pandemic.

    “I applaud and unequivocally support Governor Pritzker’s actions to extend the stay-at-home order to protect all Illinois residents,” she said. “Nothing about today’s ruling will change the city’s intention to continue imposing the stay-at-home restrictions. We need this effort to keep all Chicagoans safe and health, and we will stay the course.”

  • Lightfoot says she fully supports the state’s plan to appeal the ruling, saying that it threatens to “destroy the collective progress” the state has made against the spread of the virus. “(This ruling) gives Illinoisans the wrong impression that we have beaten COVID-19,” she said. “Let me remind everyone that the governor’s stay-at-home order has played a crucial role in our data-driven, robust response to COVID-19.”

    City data has indicated that the stay-at-home order has helped to flatten the curve in terms of an increase in the number of coronavirus cases.

    Despite that progress, Lightfoot says that adherence to the order and social distancing guidelines remains key to ensuring that progress will continue to be made. “Continued compliance will be needed to keep flattening the curve and ultimately lead to a decrease in cases,” she said. “Contrary to what this ruling suggests, we must all be in this together, and only through cooperation and collaboration can we contain and limit the effects of the virus.”
The purpose of the quarantine was to flatten the curve. That has happened (it's right there in the news report.) It was never to "beat COVIC-19." That's impossible. Everyone is going to get this at some point, but hospitals aren't overrun, ventilators are plentiful, masks are being produced.

Time to open up the economy and get people working again, before Indiana, Wisconsin, Michigan and Iowa steal away what's left of Illinois business.

SCC, a letter to the editor in the Wall Street Journal opined that the compact JB entered into with other Midwestern states in regards to reopening is unconstitutional.

I can't recall the actual amendment it ran afoul of but was interesting to read.

Not saying that this virus isn't contagious or can't be deadly, but 80% - 90% of the people that catch it recover from it. Having said that, here's something to think about....

During past epidemics/pandemics (flu, TB, etc), who was quarantined? Answer - SICK people.

Who is quarantined during this pandemic? Answer - HEALTHY people.

Why the change? Could it be that the idiots pulling this scam (lockdown) knew that they could not inflict maximum economic damage on the nation's economy by quarantining only the sick people, many of whom are older so they are already retired and/or in nursing homes? So the alternative was to quarantine the healthy people, AKA almost the entire workforce, so the economy collapses.

Think about it. And our governor is doing his best to keep us locked down into the fall. Remember the schools were told to be prepared for "remote teaching" when school starts!

Ultimate goal - federal bailout or bankruptcy so Pritzker can walk away from the debt, including our pensions!

You have to wonder where does all of the money come from billions and billions of dollars being thrown at this? Why are so many city state and county workers still sitting home getting full paychecks pension paid into full benefits doing nothing? Other cities county and states are following so many workers, but then again many headlines are screaming that many are getting more sitting home then going back to work not the state county and city workers regular workers from unemployment. The original purpose of the quarantine was to not overwhelm the hospitals (they are empty), so empty that the nurses and doctors have hours upon hours to spend on the choreographed dance moves which they promptly post to Tic Toc, a Chinese made app, go figure.

They just moved the goalposts AGAIN to keep the quarantine going to beat Covid19 or the Kung Flu as a I call it.

That federal law, 42 U.S. Code Section 1983, allows private citizens to bring lawsuits for constitutional violations, including damage claims, in federal courts. Trial court decisions are not precedent. Not even for that court, not even for that judge. The Illinois Supreme Court will only take the matter if there are splits among the appellate courts. But even when there are splits there the ISC will often times let those splits remain. Chicago trial courts are free to rule to the contrary of downstate courts and do all the time. While a downstate ruling might be influential, it certainly is not precedent for anyone.

Testing, testing testing, what does it accomplish, you can be tested today and show negative for the virus and positive tomorrow. Also why is the "Cured" rate for Illinois so low compared to those reported to have the virus, something is wrong because admissions for the virus are down in all hospitals, are the hospitals not reporting those discharged, and is the Illinois Department of Health not tracking those "Cured".

That is 100% protected freedom of speech however, both under IL and US Constitutions. Even lawyers have freedom of speech to criticize the courts/judges in public venues. The shit talking was done in the media, not in a court room in an improper way in any legal proceeding.

Saying the court 'got it wrong' to the media is not prejudicial to the administration of justice within the court system and it's procedures. Further, both the mayor and the governor spoke of their dislikes of the ruling in their capacity as civic leaders with reasons they think the ruling can 'harm the public interest'. Their duties as leaders does concern public interest and public harm elements which their leaderships might diminish (lessen the possible harm) in some way if possible.

I hate Fatass and Groot as much or more then you do... What they said and where they voiced it cannot be used against them as relates to their standing to practice law.
Even jackasses in government have liberty to speak their complaints about other parts of the government.

These scammers don't want the federal courts exposing their corruption. Once the federal scale of income vs debts is weighed they'll be advised that their income to debt ratio based on current revenue streams does not grant them the right to file.

This same shit happened in Shitroit. They cried bankruptcy, feds reviewed the past current and future streams and revenue plans and told them sorry shitheels, you don't get to destroy the pensions so you can keep finding new voter base shit to spend the money on. ALL creditors get a look at the books AND the revenue history and future plans. They can't hide and protect their cronys enough to steal pensions and keep their political handlers fed. They ALL have to take a haircut and they ALL get to see how the money's been spent.

And both these two democRATS have been in office long enough to take the blame for how the money is being spent now.

You're not familiar with "quantitative easing" apparently. Also, debt service payments are the reason why the public is being whipped up into trying to justify holding China accountable financially for the world's economic losses. We don't have to take them to court, we can print money and stop paying down debt to China. That spreads the losses across the next 10 years without american citizens having to pay it all back.

It is Article 1 Section 10 paragraph 3

Interstate compacts cannot happen without consent of Congress.

42 U.S. Code Section 1983 is for civil rights violation & the venue is obviously in Federal courts. If you suffered individual harm from these lock downs, you don't have to go the more costly route of making a federal case out of your injury. Keep it local, to a state trial court, and save half your legal bill.

You don't need to go to Federal court (way trickier procedure wise) when raising constitutional issues per the state's constitution. What the fat governor and the mayor troll lady are doing can be framed plenty wrong under the Illinois constitution with it's bill of rights. However, as with all legal matters, you have to prove your injury occurred and that such injury resulted from the defendant's doing.

Expect both federal and state lawsuits over this Illinois stay at home shit to flood the courts starting in the fall.
