PBPA Arbitration

So the supervisors got some sort of Contract today via the arbitration process and they took some hosing from Groot:
  • Mayor Lori Lightfoot announced Friday that the city had reached a deal that included several police reforms through arbitration in contract negotiations with the unions representing Chicago Police Department leadership.

    Those reforms include "allowing anonymous complaints to be investigated, ending the requirement of destroying disciplinary records, preventing the names of complainants from being disclosed to officers until they are interviewed" and others, Lightfoot's office said in a statement.

    Arbitrator George Roumell Jr.’s 106-page award sets terms for the city's next contract with three Policemen's Benevolent and Protective Association (PBPA) units that represent more than 1,500 sergeants, lieutenants and captains in the Chicago Police Department, Lightfoot said.
A couple of sergeant readers say that a bunch of this is spin by Groot:
  • The PBPA is going to sue the City after the Contract is ratified because the anonymous complaint portion runs contrary to the Sworn Affidavit portion of State Law. The City cannot make or enforce an agreement that is against the law. 
  • The requirement of destroying disciplinary records was awarded to Groot last week in a court decision that we referenced in a post.
  • The preventing names of complainants confuses us...
Anyone ever read a Court Complaint? Where it says something like "...duly sworn under oath...." Court proceedings do not go forward without a signed complaint. The complaint itself is an attested document by means of the Officer's witnessing it - we are all Deputy Clerks of the Court for a reason, and this is it. How is any supervisor (or officer) supposed to address the Complaint without the full picture, reports, documents, etc? They can't, which is why court cases are nolled all the time, and we predict a lot of the same with "investigations."

By the way, the canard about how having a name attached to a complaint is somehow "chilling," we will remind all readers that as far as our research shows, at no time since the Sworn Affidavit was put into place, has any Officer been accused of intimidating or harassing a complainant. The criminal penalties are more than enough to deter this sort of behavior.

The retiree health care went up to 3.5% and there were other housekeeping items attended to. Here's a basic overview (click to enlarge):


Groot is desperately trying to make this into a bigger deal than it is and faces an uphill battle to make the one "win" stick if the Courts follow the actual law as passed by the Legislature. This was a decision handed down - no sergeants, lieutenants or captains ever got a vote on these items.

Hopefully, the FOP learns a few lessons from this.

So 9161's are looking at 3.5% for 55 and out on the medical insurance.

Also, the arbitrator ruled in favor of the city changing paydays from the 1st and 16th to the 7th and 22nd? This is going to affect the amount of taxes paid when Duty Pay and OT are paid on the 7th. The arbitrator also ruled everyone must go to Green Slips (direct deposit), so the argument that the city spends more money printing multiple checks is null and void.

How much do you think the arbitrator may have took in the suitcase from the City, allegedly of course?

It was a fair ruling by the arbitrator... insurance going to 3.5% is not
bad at all as it increased the same percentage as when working.
A favorable ruling in that Company time is yours! So if one goes in front of the
Police Board you don’t have to worry about losing your comp time!
That’s what forced most of the officers involved in the McDonald nonsense to retire vs risking losing
their company time.

They never cared if people lied anyway, no one ever got charged with lying. We were never getting the retirement age lowered. So all in all it isn’t that bad. Remember when Hillard was in charge, how many times did he say, “we’ll fire you”? By The arbitrator Including the “anonymous complaint” LL is claiming a “big win” for the city. She’s trying to save face because she knows she will not do anything better with the FOP. You can bitch and moan all you want but at the end of the day we got 12% and kept just about everything else. The increase in insurance was expected as well. Anyone who has 29 years and is 55 should get out now or loose 1.5% for the rest of their lives. Expect a mass exodus.

Yes.. if you go at 63 it will still be free until Medicare age (currently 65)

FYI: The money portion of the contract was settled last September 2019. Everything else was settled by the 92 year old arbitrator George Romell Wednesday.

Word is the same will happen with the money portion first with FOP.

After reading that chart of issues it indicates that the Supervisors lost every key issue.Looks like that trusty Discipline Matrix is back.Forget to wipe your nose=1 Day Suspension.Shoe untied=2 Days.Thread hanging from shirt=3 Days ETC.Maybe that extra $150 in Uniform Allowance will offset all of the losses.

The civilians running the Department are starting to take notice. Cmdr JS will have about 90 days to make a decision based upon contract rulings. – Certainly sets the precedence for 9161 maybe won’t even get such a deal like 4% - 50. Look back to the good old days when the last conniving midget boasted “... eliminate, not cut or reform a benefit. Thank you very much. A $175 million saving!”.
During the last negotiations, many jumped off the job believed 55 & out (2015 or so) would be gone, some left to save the subsidy or at least be grandfathered in the old free health plan, or face that proposed 2% [?] healthcare contribution. Faked and scare many to retire and screwed over. Wonder when the 60 and out free til Medicare will last.

Under LightFührer, the objective is to replace every old regime CPD with a re-educated new world order polizei (Plan 1939). What they are pushing now is a Re-Imagined police department nationwide.
Who knows with maniac Larri.
Go through the lawsuit process and the city just gets away with violating Contracts.
While they go to court to fight for healthcare and they’ll slip in Pension cuts.

Same applies to anonymous complaints.
They’re altering, eliminating the fundamentals of Due Process.
Try that in criminal court, especially when the CityCounty willy-nilly accuse and charge YOU with a serious offense based on that anonymous complaint...which they do already without investigation (popcorn burglary). Were CR’s handed out for that?

Oh, and if there’s a State law that need to be changed to accommodate the Re-imagined police and benefits, there’s a IL Rep in the 1st Dist willing to draft the legislation.

Covid and Floyd rioting is fading away. Police Reforms is centering the arena.

Settle it in court shouldn’t be an option.

You do realize that this is binding and only the City Council has the ability to vote on it? You are aware of the arbitration process, aren’t you? Lastly, you do understand that there wasn’t an “agreement” or vote, don’t you? The blame lies at the arbitrators feet. What police officer (supervisors or not) would want a mediocre raise, insurance increases, discipline changes, working past one’s maxed out date in order to get insurance, etc.? FYI, the raises were agreed upon without a vote also. Allegedly, the arbitrator made it clear that the City’s offer was better than what he would award, so it should be considered. You should educate yourself prior to name calling. Better yet, become involved with your union and sit on the negotiation committee. I do realize that it’s easier to shit talk after some drinks rather than actually become involved and learn something.

Only the money part. They wanted the money up front and then went to arbitratikk OK n. Didn’t work out to well for them. Think money was 10 1/2 percent over 4 or 5 years

You have to look farther down the road.

If the legislature is successful in enacting police officer licensing, one of the concepts is to look at the officer's entire history. INCLUDING not-sustained complaints.

So while the anonymous complaints are universally not sustained, they will be in the mix. The idea that they are smoke. And where there is smoke, there is fire. According to the way the licensing board may think.

Plus, even if the anonymous complaints is a very minor minimal infringement of protection, it is the nose of the camel under the tent.

Don't complain about 3.5 percent to pay for health insurance for you and your family. There are those of us who retired several years ago thinking we would be paying $600 plus a month. Which was alot, but some of us took it to retire before age 60. Fuckhead rahm pulled that from us, and now we are paying $1700 plus a month for health insurance for a married couple. And that premium goes up $100 every year.

What's infuriating is us retirees were the ones who were promised free healthcare for life. We would all rather be paying 3.5 percent of our annuity for health insurance, and not $1700 each month. It's not fair, because we are old and sick, with illnesses and injuries from that fucking job.

So be grateful. You are actually fortunate.

Capped outside the department 16 hour OT for a week??? I have worked movie details that lasted longer for a day. A lot of us also worked back to back to back (yes 3 straight) 16 plus hour days (some being cancelled day off) at the start of these protests/riots. If the city can limit us then it should be across the board. Sorry boss, can’t come in for my second cancelled day off this week cause I already hit my 16 hour limit.

Not necessarily so. These rulings were by an ARBITRATOR. The unions and the city has no control over what he decides. Like a trial both sides present their offer, argue it, and then answer questions posed by the arbitrator. Then HE rules. And because it's binding, it must be accepted, except in certain conditions, which is why the anonymous complaint issue will be challenged in court if the rulings are approved by the city council. That's the one problem with arbitration, it's a 50/50 crap shoot.

The interesting element of the arbitration decision is the escalation of compensatory hours to be able to be sold from 200 to 300 a year. This escalates the ability of supervisors to sell hours. I am sure FOP and the city are analyzing this because of the numbers of D2A, D2 and D1 officers whose ability to sell a significant amount of hours could impact the city's unfunded mandate if a comparable provision is in the FOP CBA. The relevance of this section of the arbitration has far greater potential implications than initially appear on its face.

3.5 percent of your monthly annuity check is nothing to pay for health insurance. Especially for the same policy you have as an active employee. Us retirees who got screwed by rahm are paying 30 percent of our annuity check...for a not so great policy.

Also, the arbitrator ruled in favor of the city changing paydays from the 1st and 16th to the 7th and 22nd? This is going to affect the amount of taxes paid when Duty Pay and OT are paid on the 7th. The arbitrator also ruled everyone must go to Green Slips (direct deposit), so the argument that the city spends more money printing multiple checks is null and void.


How? You pay the same no matter what?

Just a couple of things that are being misconstrued. The changing of pay dates will not have any impact on your taxes. Money earned as your regular pay is taxed at whatever rate is assigned based on your W-4 form. Any money earned beyond that has federal tax withheld at 28%. This has been the rule for years. It is from the IRS and not the city. As to the withholding on your uniform checks, the city was violating federal law by NOT withholding tax on that money. When Uncle Sam called them out they agreed to start and problem went away.
As to the anonymous complaints, take the time to read the entire context of the award. If a complaint is anonymous there is a procedure that the city has to go through to have a designee of the city sign the affidavit. If that CR is then sustained you can grieve it and have it decided by an arbitrator. Regardless of what you say about arbitrators, if you take a beef to them that is obviously bullshit they side with the officer.
All in all the supervisors arbitrator award is consistent with the times. Deciding on arbitration is always a crap shoot. Coulda been better, coulda been a whole lot worse.

But officers can be made to work 84 hours a week for the department.

Don't complain about 3.5 percent to pay for health insurance for you and your family. There are those of us who retired several years ago thinking we would be paying $600 plus a month. Which was alot, but some of us took it to retire before age 60. Fuckhead rahm pulled that from us, and now we are paying $1700 plus a month for health insurance for a married couple. And that premium goes up $100 every year.

What's infuriating is us retirees were the ones who were promised free healthcare for life. We would all rather be paying 3.5 percent of our annuity for health insurance, and not $1700 each month. It's not fair, because we are old and sick, with illnesses and injuries from that fucking job.

So be grateful. You are actually fortunate.

You sound bitter like a retired PO friend of mine. She called me a fool for staying a little longer in the job. She just like you got suckered into leaving early with 25 on and got stuck with high health insurance. She was forced to get a full time job to pay for. I left last November at 60. Who’s the fool now, you bitter little man.

Comp. time sell back provision: To the best of my recollection, the PB&PA got the comp. time sell back section a couple of contracts ago. I think FOP brought up the idea and it was shot down because of the city's lack of ability to pay at the time. However, given the comp. time provision has been part of the PB&PA contract at least a couple of contracts the city should have had ample time to prepare for this issue. If a PO sells 208 hours of comp. time-based on 2080 hours in a work year it is equivalent to 10% of his/her salary. This is an issue the city may have to grapple with in negotiations/arbitration. A dilemma regarding this issue is the previous ability to accumulate unlimited comp. time v. the ability now to only receive time within the confines of the FLSA limits before being mandatorily paid.

I retired age 53 with 28 years. Not by choice. I was in an off duty car accident. A drunk driver hit me while I was riding a bicycle for exercise. I lost a limb, amongst other major health problems. I guess I'm a bitter fool too? Thank for the compassion, compadre.

The PBPA is going to sue the City after the Contract is ratified because the anonymous complaint portion runs contrary to the Sworn Affidavit portion of State Law. The City cannot make or enforce an agreement that is against the law.

How are they screwed? If you are Tier 1, you can leave when you want. You must stay until 55 to get the medical. Nothing has changed.
