An Unused Tool

No, not McRocksForBrains. He's been used way too often.   

But why isn't Chicago using this?
  • Kane County prosecutors have filed a lawsuit against alleged members of an Elgin street gang, the third such instance in which authorities have targeted gangs using the power of the civil courts.

    State's Attorney Joe McMahon announced Tuesday that his office filed a lawsuit late last week against 25 reputed members of the Maniac Latin Disciples. Police fanned out Friday to serve those named in the suit with subpoenas, ordering them to appear in civil court.

    Kane prosecutors have filed similar civil actions against alleged Latin Kings members in Elgin and Aurora.

    "This type of lawsuit has been effective in the past, in this jurisdiction and others, at undercutting street gangs and their ability to carry out their criminal conduct among law-abiding citizens," McMahon said.

    The suit seeks unspecified damages from the alleged gang members. It also seeks to prohibit the members from openly associating with each other.
Prohibiting members of a known gang from associating with one another? Holding them civilly liable for acts of intimidation including loitering on corners, wearing colors, flashing signs. It has withstood a couple of court challengers and been used successfully against large criminal organizations. W'eve heard talk about using RICO-type laws against gangs....but here's one in existence already that seems to work. And based on our giant Contact Card system and "two-degrees of separation" strategies, why couldn't this work on a massive scale? Rahm might actually make some money off it to close his budget gap.

Of course, certain politicians would have to find other sources of campaign donations, wouldn't they?

Money is Power,

Which empowers Chicago politicians more: creating a living wage job, say $70K a year job, or sending someone to prison?

Well if they send a person to prison then that can be used as a tool to extract $143/day (according to preckwinkle) from the rest of the taxpayers to keep them incarcerated.

That is about $52,000/year.

On the other hand you would have to have someone earning about $1 mil/year to get $52,000 in tax revenue.

So if you're not making a million dollars you are more valuable to the politicians being sent to jail. They get their hands on more money that way to spend as they please and to build their empires.

Therefore, why worry about educating the next generation for some min wage job. The tax revenue is chump change to them.

Go figure?

One year the city shuts down a beach when fights break out involving maybe 100 people, telling the public that they are concern for peoples safety because of the weather. Why it's 80 degrees out and we fear people will become dehydrated and get heat stroke. We're afraid that first responders will be unable to get to the people that need them.

Fast forward to Fri...

Over a million people will probably hit the streets. It will be 80 degrees and humid and we're gonna ban coolers in an effort to stop public drinking. Really? Yes really. No tolerance!!!

Sounds like a disaster waiting to happen. yeah?

I'm no lawyer or cop, but if this is true. What happens to "freedom of association" ? As for loitering well that's subjective. But street lounging is is a violation. I remember way back in the 70's I thought chiraqastan passed an ordinance it was a violation for five or more people to be on the corner hanging around.
Might be a fight to make them stick

COs in Asset Forfeiture brought this up years ago, using counties in Texas and California as models. Unfortunately, after extensive briefings and meetings CPD couldn't convince the Cook County State's attorney's or the corp counsel to get on board.

ASAs are so much smarter than anyone from CPD.

In a painfully embarassing moment, Rachel Jeantel was asked to read the letter out loud in court.

People who should file the law suit; city of Chicago, state of Illinois, the Illinois attorney general and the cook county states attorney. That propaganda goes on and on about "economic growth" and all the benefits of exporting it around the globe.

We are told that coal exports are creating jobs in Illinois. HA, now go over to the BLS and try and find the increase in mining jobs in Illinois from this so-called five fold increase in coal exports hype.

No material increase in the number of people employed in the transportation sector either as one might expect from the propaganda.

without juice, this department has you on the list of expendables when it needs pawns or fodder to toss to the wolves on a platter when it needs to look like it's gonna get serious about cleaning things up. LAPD has used civil injunctions for some time. In fact, they have the info on their webpage listing which gangs have injunctions against them. Civil court = preponderance of evidence, so the burden of proof is lower.

We won't use it here because it's not from the NYPD. BTW, how is stop-and-frisk doing there today? Effectively shut down.

Was your response to the original post a joke? Or were you inebriated?

First, if you could read, you would have read the article begins with Kane County Prosecutor/States Attorney Joe McMahon filed....blah blah blah.

Second, criminal and civil cases must have a crime in order to file. Who do you think conducts the investigation? The Organized Crime Division works very closely with Asset Forfeiture States Attorneys, because the investigation is multi-faceted with the dope, guns, gang association, and monies. The states attorneys happen to work out of 26th street.(heard they were moving from Daley Center, unsure cuz I retired)

Third, why in your first sentence did you say this has nothing to do with 26th street, and in your next sentence you say this has to be filed by states attorneys?

Fourth, you sound like a detective, and one that has never worked in OCD. Some of the best detectives originated out of OCD. There truly is alot to learn in OCD, and in its a tremendous base to becoming a good detective someday. You have a a lot of investigative resources and techniques in that are utilized in OCD that you will never use, nor the majority even know exist in the D unit.

Meaning, in the D unit, you are handed an investigation with a crime handed to you = which included at least one name (victim, and you follow up to solve the crime. In OCD, you have to initiate the investigation with absolutely nothing handed to you, and you have to follow up = all while being undercover. (and I'm talking short and long term investigations) I always said OCD personnel should be receiving at least D-1 salary, if not D-2.

I didn't write the original post, but I felt the need to respond. I must say I do agree with the original post in that cpd officers are definitely not the best report writers. Less is not more nowadays. However, the exempts never liked long term investigations, which require alot of time and tons of documentation. So that doesn't help officers to learn proper investigative writing skills when everything is rushed today by our exempt.

The point that was made and missed is the original poster made it seem that states attorneys at 26th street,detectives and OCD officers are to stupid to file such paper work. My point was that they don't file the civil suits. It's the city of Chicago(Mara Georgas)state of Illinois, the Illinois attorney general(Lisa Madigan) and the cook county states attorney(Anita Alvarez. I'm pretty sure she doesn't work at 26th st.
