That Use of Force Update

General Order 03-02-03, Section III-E has been updated as follows:
  • (Use of firearms in the following ways is prohibited) Firing at or into a moving vehicle when the vehicle is the only force used against the sworn member or another person.
This part follows:
  • Sworn members will not unreasonably endanger themselves or another person to conform to the restrictions of this directive.
That's it. We're pretty sure there used to be a section in there saying that if it was possible for the officer to move out of the way, that was required.

We'd like to see the old directive to see what exactly changed. And it must have been something, because the PBPA is not happy and raising questions - we got this from a e-mailer who culled it from the President of the Chicago Police Sergeants Association:
  • MLAS [has been contacted regarding] our objection to the change as it contradicts the department's protection of life policy as well as the use of force model. The addition of this prohibition even contradicts the very next sentence in the order that states sworn members will not unreasonably endanger themselves or another person to conform to the restrictions of this directive.
The letter goes on to say that the sergeants are meeting with their counterparts in the lieutenant and captain associations to address this rewriting of the order without input from the officers it regulates.

Is the FOP going to hop on board after the white shirts do the heavy lifting or what?

firing at or into a moving vehicle is only authorized to prevent death or great bodily harm to the sworn member or another person. When confronted with an oncoming vehicle and that vehicle is the only force used against them, sworn members will move out of the way.

If you shoot at a person driving a car and no gun is recovered, the FBI will open an investigation on you, your partner, and every CR number you've received.

The FBI will do what they can to put you in prison for the shooting or for any prior incident.

The City is aware of these investigations. After you go to a federal prison, the City doesn't want to lose millions in the lawsuit, so the City changed the GO and can now argue that you were a rogue officer who violated the rules.

This rule change came straight from Corp Council, not McCarthy.

These are best minds are chosen by the Supt, many of the meritorious, prodded up the Dept ladder to solve the city's biggest problem.
Simple fix...Dump Rahm, get a new Superintendent.
It won't alter the cycle of urban violence but the change is going to make you feel good, if only for a month or two, someone has to be responsible for 011,015, 025 and all the others dealing with bad management.

Mcnitwit has been wanting to change the order for a while, but met stiff resistance from the assistant director of research and development. His solution was to promote a sergeant from chief tracey's office to director of research and development and poof! The order was changed that day.

He would rather be politically insulated than have some officer second guess himself on the street and end up dead. Fuck these New York clowns.

Why would the police sergeants endorse the only candidate who defends our pensions, who says he'll use TIF money to make the balloon pension payment, the only one who hasn't touted the hands up don't shoot motto? He's against the cameras and for the police, and plans to dump McJersey, but don't endorse him, for God's sake!

This is very clear, it puts the burden of proof on the officer and clears the city. It allows the city to throw the officer under the bus after being attacked with a car. It puts all the liability on the officer. While that is pretty much the case all the time, this gives the city the opportunity to not indemnify the officer should he be put in the position to use deadly force against an assailant driving a vehicle.

Officer gets hit by the vehicle, this wording eliminates the possibility of the officers family successfully suing the city over an order that put the officer at risk by not allowing him to defend himself against a threat. The city's claim?? "we told them not to unreasonably endanger themselves.."

Officer fires at the vehicle wounding or killing his assailant? The city will claim he did not follow the department policies. Officer has a major uphill battle to prove that it was reasonable to operate outside the authorized use of force. This increases the likely-hood of punitive damages and even criminal charges against the officer.

2) Being sued

That was outrageous that a law enforcement chief would allow that. What's next? Would he allow that at the Tomb of the Unknown Soldier at Arlington National Cemetery?
There was another video I was sent where ISIS invaded a World War II British Memorial Cemetery in Libya. It showed groups that had defecated on soldiers gravestones then rallied as they smashed and pushed them over.
What is next for them? Will gangs from ISIS or sympathetic to Muslim extremists now invade the American Cemetery overlooking Omaha Beach or outside Bastogne Belgium and do the same thing?

Will Obama demand these countries or our own embassies increase the security to the point of using force to defend these sacred sites?

This is what happens when the votes of such (fill-in-the blank) are more important that the votes and welfare of their police officers.

I'm not saying the city doesn't want to do this and cut 2,000 police officer positions all the while FOP is out to lunch on our dime. But I can see this happening soon. Remember boys and girls if your on 3rd watch now you will be on 1watch next yr, count on it with the 40-60 split. I'm still waiting for fop to explain why on earth any of them would put into the contract purchasing vehicles as a collective bargaining issue. This is an indicator of an epic fail on the entire fop leadership. This time next yr you'll all be working midnights, 5 days straight, no CU, burning 10.5 hrs of time for 1 day off if you get it approved, no time for wife, family, or your side job and driving around a beater of a squad all the while the chosen few are on SS DOG, 8.5 hr day living a normal life. And that faint laughing you hear in the background is fop leadership, slapping themselves on the back for the BS they shoveled and you believed .....

Can't for the life of me figure out why so many po's are against this order. There is no reason why you can't move out of the way of a moving vehicle. What if you fire into the vehicle and you shoot somebody other than the driver, you're going to be sued and if you hit the car and not any people, then you can be sued for criminal damage to property. I'm a ppo in a south side district so my understanding of the law is a lot fresher than those of you who have been out of the academy for a while. If we didn't have so many trigger happy po's than the department would not have put this order out.

My ISP son was murdered by a wanted person aiming the car at him in 1986. He did what the orders specified; ie, stand and aim weapon; and he gave his life. The driver spent 13 years in the joint and now lives free and easy in Franklin Park while JK is in the cemetery. Is this right ? IS THIS JUSTICE ?
