Wait....What?

We're not surprised something like this happened - we're just surprised it happened in Oklahoma:
  • An Oklahoma police lieutenant has been indicted for second-degree murder in the May 20 killing of a woman during a vehicle pursuit. Supporters of Blackwell, OK, police Lieutenant John Mitchell say the suspect was an active shooter. The media describes her as a “road rage suspect.”

    Oklahoma City grand jurors concluded Lt. Mitchell acted without justifiable or excusable cause and engaged in "imminently dangerous conduct" toward Micheal Ann Godsey. If convicted, he faces at least 10 years in prison.
And what was Ms. Godsey doing?
  • "She shot at the police twice. She has shot at her mother twice. She has shot at a private citizen. We know she fired other rounds around town. And Mitchell gets in behind her," the attorney told the Oklahoman. "He took his AR-15 and he started shooting through the front windshield at her."

    Godsey, 34, was found dead in the driver's seat of the pickup, the Oklahoma State Bureau of Investigation said in May.

    The attorney said Mitchell had just completed training on how to deal with an active shooter and was cleared by an independent internal affairs review of the incident.
We'd expect this bullshit from Crimesha. This sounds like a case of brilliant tactical positioning to eliminate someone blasting away at citizens. We can't imagine this getting anywhere near a guilty verdict.

This is exactly the reason everyone should go straight to the hole after roll call. Windows always rolled up so we don’t hear potential hollering for “police.” Absolutely zero eye contact to avoid hand waivers. At the hole squad car lights always shutoff. F the visibility, hide, hide, hide.

This really worries me since I want to escape Illinois to Oklahoma as it's a completely red state. I'm wondering if the shooting through the cruiser windshield while on the move was the determining factor. I've seen videos of police doing that and it looks somewhat cowboy-ish.

Specifically, regardless of her prior action, did she point or did she point her weapon in the direction of the lieutenant or others? Also, I'm certain the lieutenant, like so many of us have done, didn't take the time to write a "concise narrative" that articulates,supports, and reasonably justifies his actions. Also, the opposition is going to look for conflicts between your paperwork,verbal statememts,witness statements,in-car video,and bodyworn camera footage. Finally, did he follow his training and department policy. Use SCC as a training aide... be smart and KNOW YOUR JOB and what it takes to survive.

I'm currently on a Grand Jury outside of Illinois, one day every three weeks for 18 months. The prosecutor presents witnesses and other evidence and asks for indictment.
There is no judge and no defense. It only takes 6 yes votes to indict out of 12 jurors. If no indictment, the prosecutor can try again another day with a different Grand Jury. And the prosecutor gets unlimited tries. Then and only then does the case move to actual charges against the defendant.

Hence the saying that a Grand Jury would indict a ham sandwich. Eventually.

Not all places are as restrictive as Chicago, and even still, you SHOULD be safe from prosecution because she is fleeing a part 1 forcible felony while armed, and deadly force is still allowed under state law. I imagine Oklahoma can't be much different.

There's a prosecutor who presented things to a grand jury in a way that does not match what facts we have. This prosecutor, if the facts stand up that the decedent was in fact an active shooter, should be tarred and feathered.

I spent 13 years working police in this part of Oklahoma. My suspicion is that the prosecutor took this to the grand jury with little expectation that they would return an indictment. My guess is that the prosecutor wanted only to be able to show that he had done all he could. In fact, the Oklahoma County prosecutor is a former municipal police officer in an Oklahoma City suburb. The urban denizens of Oklahoma City can be thanked for this.

Remember CPD changed its policy for the use of force on fleeing felons. If the offender, regardless if he shot and killed several people (there by committing a forcible felony) , drops his weapon and takes off on the police and is “ no longer “ a threat you cannot shoot him per CPD policy and can lose your job even though at the state level you can. You can run so many active shooter scenarios in ur head or persons with a gun and know u may get screwed even though u did the right thing.

What has happened over the last decade is that police are no longer given the benefit of the doubt as to the circumstances of their actions. Have gone from assuming they were generally right, though not perfect but their hearts were in the right place, to where their actions must be perfect as reviewed by passionate rabble who have no idea what the police deal with. The damning evidence against them is often a bystander video that is turned on well after the incident starts. And then edited by the news media.

Maybe the best course of action is if involved in a shooting is to make NO statement at all. Garrity doesn't matter much anymore. You might have some leverage if you Miranda yourself.

Allegedly fired 60 shots, that's from the USA Today article and also in this article by a Fox station in the area. I haven't heard anyone refute that as yet. "The Oklahoman reported. Responding officers reportedly pursued Godsey's pickup truck and exchanged gunfire with her before her truck came to a stop". According to what a cop buddy in Norman, OK told me the LT , during the chase, leveled his carbine on the dash and fired through the windshield from inside his squad during the chase, at high speeds, making a mag change, and firing the total of 60 rounds. If so, that throws a monkey wrench into the entire episode.
